Its a good find. It may well turn out that these cops acted improperly, but you can bet the arguments will lie with the different sides of what happened - as you say, no one is going to try to argue statutes in this case. For example, if the Plaintiffs say that the order of force is supposed be taser, pepper spray, then gun, the police are going to say that the threat of the possibility of a gun in the guy's pocket supercedes that.

I hope this gets more media coverage, as we still haven't heard much from the police about this incident.

In my opinion, 'he may have had a gun' with nothing given that would lead them to believe that isn't good enough for neglecting policy. If it were anyone could be shot at any time and 'I thought he might have a gun' would be accepted. The procedures are set out specifically to stop that type of thing.

Of course it is, cause only one side of the story has been released. If you believe everything the suit claims there is no point in having a trial.

You might as well just throw all of the Wilmington police and the Delaware state police in jail and disband the entire police units all the way to the top. Cause the lawsuit claims they were all part of this big conspiracy dating back to 2001 to ruin the nice motorcycle club.
