    Citation for trying to avoid an accident

    Hello, First time here got a citation for Fail to use care n stopping. tryed to avoid the car in front of me that rear ended the car in front of him I slammed on my brakes and swirved left in the wet road to avoid hitting him but clipped his rear left side after he smashed into the back of the car in front of him and I get the citaion.

    I hit the back of someone when I was 17 and I didn't get a ticket...

    That sucks I know the conditions were wet and thought I did have enough space between. Just sucks

    Thats not always true in Mass. Three years ago on 93s, in Medford, I was rear ended, he pushed me into the car in front of me, and that car into the next one. The van that rear ended me was the only one cited, actually he was arrested(driving after susp of lic).

    at fault, yes, but I was not given a ticket and a statie had, as far as I know, witnessed the accident. It was wet, and I hydroplaned into the car in front of me (thanks to a huge puddle), who had to slow down very quickly because the car in front of him slowed down very unexpectedly, on the highway, in the left lane, at night, in a storm. The cop actually yelled at the guy that I hit, but was very nice to me. I'm not sure why he was stopped, with his lights on, but he responded to my accident very quickly so I assume he saw what happened.

    Also not at fault or cited if someone cuts in front of you and immediately slams on the brakes, their fault for unsafe lane change.

    Most of the time you're at fault if you're following too closely to stop in time, but there are exceptions.

    That dude from Godsmack is about to lose millions because he hit someone that rear ended the person in front of them. I hate Godsmack but he's getting screwed. At least no one got hurt. I believe in MA you are always at fault if you hit someone from behind. Even if you don't get cited, the insurance company will still screw you. But maybe I'm wrong. Maybe some of the cops on here will add some color.

    No. In a multiple accident as described the 1st vehicle to make impact is at fault in Mass.

    I'm also not sure that this is true, as I had a gf back in high school that got rear ended and then rear ended the driver in front of her and she was found at fault for rear-ending the person in front of her even though she got hit by somebody going nearly 40 when she was stopped.

    I was the second to make impact the car in front of me rear ended the car in front of him when he made impact he suddenly came to a complete stop and I try ed to avoid the hole thing just barely missing

    Yep, I've been in this situation twice (the middle car) and the guy behind me was the one whose insurance paid for the damage to my car, and the car I hit.

    I hit the back of someone once, and didnt get a ticket...

    Well technically the back of his truck hit the front of my car as he got nervous at a railroad crossing, and decided to back up on top of my hood...

    Bummer about the citation. In the future, if you did have enough stopping space and it was the road (plates in the road, ice, etc) that made you not be able to stop in time, might be worth appealing any insurance surcharge with the Merit Rating Board.

    (I've luckily never had to do that but found that link through the blog of my awesome family owned insurance co.)
