    parking lot fender bender: what should I expect?


    So I was backing out of a parking spot from Moe's at night when there was a minor fender bender between my tacoma and a compact sedan.

    He was moving into a parking spot while I was backing out of one, when the vehicles made contact: my rear bumper and his rear door on the driver's side.

    I have a clean driving record of nearly 8 years.

    What should I expect?

    50/50? SDIP points?

    You're a MA resident, correct?

    MA is a no-fault state. I could be wrong but it's probably gonna be 50/50... insurance will cover it but you'll probably have to pay a surcharge & get a couple of points.

    For you to have to pay a surcharge and get points, you would have to be found MORE than 50% responsible... meaning if it is found that you were each 50% at fault, you would not be surcharged or receive points resulting in a higher insurance bill.

    You will get it where the sun don't shine 3 times over, particularly if they don't establish fault.

    If you can establish that you are not at fault, or more appropriately he is at fault, your insurance company will try to claim your deductible from the other company and you could be in a good place.

    I have had 2 "fender bender" accidents, both times not my fault (rear ended), my insurance company assigned fault to the other dude based on my reports and the police accident report which you need to file ASAP and my stuff was paid for AND I got my deductible back. No points or surcharges.

    If that were me i would expect a raise in the insuarnce rates, but i dont have a perfect record. Fight it and bring a copy of your driving report with you and show that you have a clean record. that should be enough to get you off the hook.

    other than that i would say you were at fault more than 50%

    Did the cops come? Did the write up a report? My daughter had an ACCIDENT, (thats why its called an accident...otherwise it would be called an 'on-purpose'), and the police officer said specifically that she would '...let the insurance companies sort it it' because there was no clear 'fault'. The car was totaled, Insurance paid, not points, no pain, no problem.

    I have State Farm and live in NH. Not sure it that plays into it or not...but sheesh, 8 years with a clean record? As long as you weren't drunk or the cops found you solely at fault this will end up being a pretty small bump in the road of life.

    This man is incorrect. If the accident is trully 50/50 then no points are added and you do NOT pay your deductible.

    The only time you pay your deductible in MA is when its YOUR fault (ie 51% or greater) or when you get points. Believe me I know I have had a few accidents in this state and know the law VERY well.

    Exactly, as I said before you would need to be found more than 50%... and it is not uncommon for the insurance companies to do this. My girlfriend works for commerce and sees claims like this all day long.

    because he was moving forward i am sure that he had right of way. You as the person moving in the rearward direction have to yield to oncoming traffic.

    For example if you are backing out of your driveway and somone hits you its your fault. even though they should have been paying attention. you are moving into someone elses path of travel!

    Honestly ask a police officer, isn't there one around here. Nikon? see what they have to say about traffic rules and accidents!

    generally if your in reverse and hit someone, your 100% at fault, but MA may be different

    I meant to say that I was reversing out (not pulling out), and I don't exactly remember, but I think I was stopped when the contact occurred.

    under what circumstances would something like this end up as 50-50?

    Wait, so you were backing out of a space while he was pulling into one, you were STOPPED, and somehow his driver door managed to contact your bumper? So you're saying that you were backing out, stopped, and he slid his car sideways into your bumper?

    If your vehicle collided with another while you were backing up, you're fucked. You can appeal the surcharge when you get the notice. I've been waiting 22 months so far to have my say on one.
