One of the risks of living in a very rural place where there are no zoning rules is that your neighbor could very well do something you don't like. If you aren't comfortable with that risk, move into an uptight HOA and get on with it.
I'm making a lot of assumptions here because I don't know the painful details. But thus far this whole thing smacks of a technicality. If you remember, they applied for and were granted a modified site plan to operate the way they were. It would seem the town failed to follow some sort of open door or public notification process to the T. And this judge felt compelled to throw the book at both the town and NYST. I find the fines directed at NYST especially absurd.
Tony's right. They need to re-apply and encourage/assist the town in following procedure to the mark. Get feedback from the cranky neighbors, do your best to at least look like you are trying to mitigate those concerns.
Based on the reports I've read, the town council and administration still support the project.
That said, I'm not paying to go up there until they get this straightened out. I have no idea how the court decision would be enforced. I'm sure a Sheriff would be involved. But I have better things to do that go pay for the privilege of finding out.

Unfortunately, I think the real news is out.
The question is how will it be enforced this year, while the track is submitting a new plan.
I think the first Member Day is beginning of May. I hear it's sold out. Is anyone registered for that?

I am signed up for May 4th and from the looks of what they posted on their FB page, it will still be running but in small groups. No mention of engine or decibel limitations.

Do you mean TTD's or the Track's own member days?
Either way, nothing new is out and nothing will be out. The first member days are coming up soon - that will be the real "test".
If you are going through TTD, then I will send something out via email after the first member day at the track.

Not sure if it's been said, but just wanted to clarify that the track lost the stay hearing, not the appeal. They are still waiting to go to court for the appeal.

I called them last week to get an update the leagal stuff.. They took my number and told me the manager would call back.. I didnt get a call back :frown:

What update are you looking for? everything is pretty much spelled out in the news. The people of the town will be watching them all weekend.

If noise is really the major issue, why doesn't the track model after Laguna Seca and mandate a noise level with monitoring?
