    Make the police report, and tell them the truth - the driver of the truck pulled out of a side street, failed to yield the right of way to oncoming traffic, and caused about $1000 worth of damage to your bike.

    They will likely assist you in tracking the idiot down.

    I dont know the law in other states, but in Vermont you are required to stop and render appropriate aid.

    yeah, he stopped asked if rob was ok, and then took off like a bat out of hell. with an unregistered trailer. sorry im still grumpy about this....

    of miles/roads. Perhaps if you gave a description of the vehicle / type of trailer someone

    In NH he can be charged with leaving the scene. Some states (like FL) if there is no physical contact between the actual vehicles there can be no charges.

    (At least that was the NH law in 2006 when I was forced to total my Tacoma because a big-rig decided to come into my lane)

    I don't know why peopel are telling him to file a report... It will only go down as an accident of his (in the 3 states I've lived in)... Since there was no contact - and no 3rd party witnesses.

    That may be a disadvantage in MA (no fault??) but for sure in NH you bet your ass my Insurance company sent a PI to the trucking company's HQ in Winconsin to try to get to the bottom of my accident, and even though my insurance paid me cuz he left the scene, my premiums never took a hit, and NH (being a by fault state) I was determined to be not-at-fault.

    So had the trailer been registered then your husband wouldn't of crashed? Hate to sound like the dickhead but that's the way people drive and you need to be ready for it. He made no contact with the bike he did stop and ask if he was ok. Good luck with the report etc... hopefully the cops in your area do their jobs better then the MA state police did when i was hit on my bike and the guy took off.

    No, if the trailer had been registered, he would have been able to get a plate number. Now because the asshole was doing something illegal in ADDITION to driving like an idiot, we have no recourse.

    And asking if you are OK while your bike is still on the ground is not acceptable when it is the other person's fault that you crashed in the first place, and they know it.

    In MA u need to report it if the damage is over 1k .. even if you do the police dont send anything to the insurance company.. if u decide u want to claim it then do that on ur own.. chances are they will find you more than 51% without the other persons information. As for being at fault it was the other persons responsibility to ensure that it was safe to enter your lane of travel. you had the r/o way and would not have been cited or found at fault.
    My wife was cut off and grabbed a fist full of front brake.. same scenario but the guy just kept going while she lay in the road.. luckily she wasnt hurt and the sliders protected the bike. had i seen it happen i would have gone to jail for sure.

    I'm not sure why people are so quick to believe this "No contact no fault" rule - I've never even heard of it, and it doesn't make a lick of good sense.

    There are plenty of crashes caused by someone driving like a fucktard, in which the conscientious driver avoids the collision with the other driver only to hit something else. Just because a driver doesn't smash into someone who violates the law does not make them at fault. Using that logic, it would be smartest just to ram into people who cut you off.

    In Vermont at least, no such rule exists and I would still urge reiobard to report this incident to police ASAP.

    I had an accident once in my car where an 18-wheeler moved over into my lane. I was forced to swerve or be run over and I struck the rear fender of other vehicle. My insurance called it a phantom driver since I wasn't able to get the plate of the truck that technically caused the accident. The truck just kept going like nothing happened.

    I know it's not quite the same scenario but I wasn't found to be at fault and I didn't have to pay my deductible. This was in MA however so I don't know if this applies in NH.

    Maybe your insurance will fix damage and waive deductible?
