    The guy is an ass for sueing. The trackday provider is an ass for making a big deal of it and asking people to pay the legal bill. Insurance should cover it.
    Refer to lawyers - problem goes away.

    I agree. Everyone thinks, OMG, THEY WANT 15 MILLION!

    In reality, jurors can spot ambulance chasing gold diggers a mile away, and aren’t stupid. This donk sounds like one of the least sympathy-deserving plaintiffs I’ve heard of, between the activity, the waiver, the riding, the missed riders meeting, the hohum injury, and choosing to ride one of the fastest sport bikes on the planet over his head.

    If I was a juror, and gross negligence was proven (doubtful), I’d award something in the range of a few bandaids, some tissues, and a “play stupid games, win stupid prizes” sympathy card.

    Dude is probably just fishing for a $70K settlement knowing it will cost the defendant $100K to defeat the suit in court.

    Therein lies the big problem. Even if the plaintiff is highly unlikely to win, a suit it costs a lot of money to fight...

    For example:
    Some moonbat out in Colorado has been convinced that the local skydiving dropzone has been specifically targeting her house with plane noise.
    She is, by all credible accounts, complete batshit crazy (she's also been harassing an airport 36 miles from her house).
    Still, though, she pushed the madness almost all of the way to the supreme court:

    Sanity eventually prevailed, but at a significant cost to the business. Legal fees, sound measurement studies, etc etc.
    The court awarded the skydiving operation $120K in damages and legal fees, but who wants to bet she doesn't just file chapter 7.
    I just hope the settlement isn't dischargeable via chapter7, but we all know how this shit tends to go...

    The way Laguna Seca is set up (facility leased to a club) and the way this has all gone down, it makes me wonder if somebody was cutting corners with their liability insurance requirements and now they actually need to use that insurance they are screwed and are drumming up fear in the trackday community to get their legal bills paid by riders.
    All speculation, of course.

    I can't speak to the cutting corners part but there is a legitimate fear of people suing track day orgs over frivolous shit despite their own culpability and negligence.

    I can't get into details but we had a similar case locally that ended up involving lawyers that cost a lot to work through the system. Damages in that case weren't medical and were under 10k total between both vehicles. This was a few years ago now and the effects of it are still being felt.

    The near death accident was caused by him being a moron and not being able to ride for shit. The sandbags probably added to the complexity of the crash, but they weren't the cause. He's an idiot.

    If you watch the video of the incident, you'll laugh your ass off at the difference between his description and what really happened.
