Incorrect citation information, does it help me?

Went to the magistrate hearing this morning to contest a speeding ticket. He offered to cut the fine in half, but I declined since the insurance surcharge is what I'm more concered about. So it's off to court for appeal.

The registration number written on the citation is incorrect, it doesn't match my motorcycle registration (one letter difference). Does this work in my favor at all? I'd guess not, but thought I'd ask anyway.

I would think it most certainly does. The bike on the ticket doesn't belong to you as far as i'm concerned.

If it matters, I've never signed, or even been asked to sign a citation in Massachusetts.

All The Man needs is "compelling evidence" to justify a "responsible" finding. Although, having the wrong reg# has helped me in the past.

Make sure you start sending out your request for discovery now. That is the best way to start fighting.

I got busted on the Cape for speeding (along with 11 other people in a group) When we all went to court, the cop couldn't even find my citation (he had all the others) and I still got found responsible.

Having a letter wrong might help you in a murder case, but in a traffic ticket, you really have to prove why you're innocent rather than the cop having to prove your guilt.

    derek

Or, make them prove you are guilty. Hence the request for discovery with every conceivable bit of related evidence to the situation. Odds are they won't be able to provide a couple parts which will get you either a continuance or a dismissal. Fight it by paperwork, not your word vs the cops.

Also, a written apology with an offer to charity for the ticket amount sometimes works. Got me off scott-free on NH last summer. They even said I didn't have to pay the charity.

Do your homework. You do have a fighting chance. Make the system work against itself and make them fight for your money.

Add Boxboro to that list. Kangaroo court & plenty of Roscoes (really, they set up freakin road blocks). I'm still hanging at 9 SDIP though.
