Big NH (6/21/2019) motorcycle accident update

I tried searching for the original thread, not coming up, there was an update yesterday:

Defense lawyer in death of 7 motorcyclists: Biker at fault

    https://apnews.com/328aa6c3807c1bc94e5874b67c41443c

CONCORD, N.H. (AP) — One of the motorcyclists in a crash that killed him and six fellow bikers on a north woods highway was drunk and actually was the one who hit a pickup and caused the accident, the lawyer for the truck driver charged with homicide said in a document made public Tuesday.

A New Hampshire State Police account of the June 21 crash in the community of Randolph “was deeply flawed,” the lawyer for truck driver Volodymyr Zhukovskyy, 24, of West Springfield, Massachusetts, said in a motion filed Friday that seeks a hearing to set him free on bail........

Zhukovskyy’s vehicle was traveling west and the motorcyclists were traveling east on the two-lane road. Crash Labs “determined that the impact occurred directly over the center line” and that the motorcycle driven by Albert “Woody” Mazza Jr. “was in fact protruding over onto the center line when it struck the truck,” according to the motion.

The initial impact occurred between the left side of Mazza’s motorcycle and the left front tire of Zhukovskyy’s truck, it said.

The report goes on to say that “the impact caused catastrophic air loss to the left front tire of the truck, which left a tire mark on the center line of the road,” Duguay says in his motion. “This tire mark had initially been attributed to an ‘unsuccessful avoidance maneuver’ by Mr. Mazza, a position that the State has since retracted.”....

The motion notes the state also provided information showing that Mazza had been turned around looking back at the group of riders behind him just before the accident and that autopsy reports show that at the time of the crash, Mazza’s blood-alcohol level was 0.135%, well above the legal limit of 0.08%.

Still a tragedy for all involved.

    None of us were there.

    I’ll speculate nonetheless.

Regardless of what caused the initial impact, the larger loss of lives might have been prevented if the riders had been conscious of leaving enough space between each bike to react to a problem ahead of them.

While riding drunk is obviously stupid, when I’m out and I see groups riding in “close formation” I shake my head.

And don’t lay this on the HD riders. I was on a nesportriders group ride in 2000 and while leaving enough space for me to react to a problem in front of me through a set of western mass twisties, I was passed on the right in a right hand turn.

Like today, social distancing works on motorcycles too

Given that I have seen bikers ride the center line to the point of being over it when riding in groups its not surprising that its part of the cause of the crash. Not sure when this became a thing? if In fact he was also over the limit well... truly tragic!

I'm not saying one way or another, but there's always four sides to every story.
    The prosecutor's
    The defendant's
    The truth
And most importantly, what the jury determines occurred

It's definitely a thing. Tough guy Harley BS mostly. They are doing it to make a "share the road, look out for motorcycles" point, but no one likes listening to Captain Hardo. Play stupid games? Win stupid prizes.

This is a tough one. Can't speak ill of the dead. There but for the grace of god go I, etc.

The truck driver was wasted high and had a history of being a scumbag working for a scumbag company. I hope they bury him.

Having said that, 2 wrongs don't make a right and I have seen plenty of scumbag behavior from the patch clubs of all types and riding like retards in packs, with a couple of beers inside is not out of the norm unfortunately.

So...some of them are dead and the other one goes to jail for a long time? Sounds like a win.

You ever watch a game like...Jets vs Giants, Yankees vs Rays, Canadiens vs Sabers...and just think "I wish there was a way for both of these fucks to loose?"

At least they didn't refer to them as the fallen 7, confused though why the driver didn't say immediately that a bike crossed into his path.

Maybe, just maybe he knows exactly what you should say in every interaction that involves LEO.

They spirited him away for his own safety pretty quickly, I believe.

Not sure about others, but my daily routine starts with some cocaine and heroin. It's a great way to start the day before heading off to work!

Glad they denied bail. I have no doubt that he would attempt to skip home to Ukraine in a heartbeat.

This is turning into a really fucked up story. It's a terrible thing that happened resulting in needless deaths. But the BAC definitely tosses a wrench into this. Fuckin' sucks either way, no doubt and I don't want to take anything away from that. But...

From the Globe a couple of days ago: CONCORD, N.H. (AP) — A truck driver charged in a New Hampshire crash that killed seven motorcyclists had fentanyl, morphine and a chemical found in cocaine in his system that day, and told authorities he often would take drugs before starting work, prosecutors said in a document made public Tuesday. The morning of the June 21, 2019, crash, Volodymyr Zhukovskyy, of West Springfield, Massachusetts, consumed two baggies of heroin and half a gram of cocaine, prosecutors wrote in a motion objecting to Zhukovskyy’s request for a bail hearing.

Yeah, I caught all that. But a .135 BAC from a motorcyclist that MAY have crossed the double yellow MAY have triggered the crash unfortunately.

It is possible, and maybe probable, that both driver and rider were at fault. No one wins...

Yup. The argument can be made that a sober truck driver would have been able to take corrective action and/or mitigate the carnage.

Agreed. Same can be said for the motorcyclist that is alleged to have crossed the double yellow too.

Re: Big NH (6/21/2019) motorcycle accident update

Sad all around, blame for everyone.

For me, it comes back to the idea I think many of us on 2 wheels share.

Ride for the unexpected, assume everyone is trying to kill you, don't ride in a compromised state of mind, alertness, anticipation or reaction speed.

None of us are perfect, but most of us seem to want to tilt the odds as much in our favor as we can.

Even if the truck crossed the line, what happened hear happens every day, in every collision involving a motorcycle and another vehicle, the motorcycle loses.
