My friends and I were even discussing it down here in GA. What a shit show...
Maybe my math is off, but isn't .135 less than 2 beers?

Definitely a defense attny trying to claw back some ground, and I believe he has. The location of the impact and the bac have just put that rider in doubt. Many times the defense story is a lot wilder than that. This one is in the realm of plausible. I think it will sway a jury. perhaps not all the way to acquittal. But a plea deal is now going to get sweeter for the truck driver.
Can the defense attorney request their own autopsy?

It's tough to say, because it depends on the rate of consumption, and body weight, among other variables.
Generally speaking, I don't think 200lb male can chug 2 beers back-to-back and get to 0.135. That kinda BAC score on a mid-weight male takes some commitment.
I think that's 7 beers all drank immediately. Time is really important here, and is often glossed over in some of the scared-straight oriented DUI info. 7 beers over 7 hours doesn't get you to 0.135.

Yes, the body can process 1 drink per hour.
A .135 on a 200 Lb guy who was drinking for 3 hours pre ride would have to be 10. beers to still be “carrying” 7.
None of this is exact, but no normal sized person hits a .135 on 2 or 3 beers pre-ride.
Lead bike allegedly crossing the line doesn't excuse the rest of the pack getting mowed down. But it does complicate how I feel about the whole situation.
What's the difference between a bolt and a screw?
First you screw, then you bolt.

It actually could only be a few beers if they were drinking the good stuff. Unlikely given the Harley crowd, but you never know.

Form the OP... The initial impact occurred between the left side of Mazza’s motorcycle and the left front tire of Zhukovskyy’s truck, it said.
The report goes on to say that “the impact caused catastrophic air loss to the left front tire of the truck, which left a tire mark on the center line of the road,” Duguay says in his motion. “This tire mark had initially been attributed to an ‘unsuccessful avoidance maneuver’ by Mr. Mazza, a position that the State has since retracted.”....
The bike hit the truck and blew out the tire...
I have seen catastrophic air loss to a car tire by a motorcycle before. cough cough. Stoneman

I had a feeling. There was too much evidence pointing to the motorcyclists. It pains me to say that, but from what I've been able to follow, I agree on the verdict. Emotionally I say fry the bastard. But realistically it wasn't his fault and the state couldn't prove otherwise.
The BAC threshold in NH is .08. Although I know firsthand of someone who lost their license with a .05 in NH because it was proven that he was impaired regardless.

It was a tragedy, but from the beginning there had been questions about the pre-ride condition of the motorcyclists. It doesn’t make their deaths less sad, but convicting the truck driver out of empathy for the deceased would not have been right and would not bring anyone back.
There was also a lot of noise about the driver’s ethnicity and background.
Had the driver been Robert Smith and a 2 tour Army vet, the narrative might have unfolded differently.
He was definitely complicit even though the state couldn't prove he started the accident chain. I don't know how to reconcile it not being his fault and him walking away scott free. Maybe they overcharged him. Someone who I really don't want to be sharing the road with in any case.

I hadn't been following the trial and the world had him convicted since the event first made the news so I was surprised to see the swing in the other direction. Now he will have to put up with years of ongoing civil cases.

Very surprising to say the least .
He’s already served 3 years in pre trial detention .
Did he have a bail bond that he just couldn’t afford ?
