Good post on the FLA case.
The FLA case hinges on whether its was a pursuit and if the biker knew he was being pursued..........
In the FLA case the tire no doubt caused that crash. So is the tire manufacturer being sued, or the maintenace dept at the SP barricks?
Or the screw manufacturer that punctured the tire a week ago?
In the NY case, its hard to determine, other than a speeding SUV isn't too safe to drive.
The FLA guy is documented in using the radio. The NY guy do the same?
There's a story (forum) I read where a Canadian guy was going 100 or so on his bike on the Rt 6 Mid-Cape.
The officer radioed ahead and they road blocked him further up.
The biker had NO CLUE he was the subject of the blockade, he thought it was a sobriety check point or similar.
You can't run from what you don't know about....
I suspect this will be debated.
and if you consider "high velocity" running....................
Then every 80 MPH ticket in a 50 - 65 MPH zone where the officer sees you pass him/her; "would be considered running."
I don't. I think the FLA case states that the public are fed up with squids and allowed these charges to be leveled starting a precedence that has no boundaries.
My problem is that when LEO "HIDES" as part of their traffic enforcement; behind objects, in the woods etc., the reasonable expectation that a driver EVEN paying attention would know they were being "pursued" is gone................
Since I have no idea in the NY case, I can't comment on it.
I present this scenerio:
You "speed" down the interstate, pick any speed. The LEO can't get you for whatever reason. (traffic stop, in getting gas, car stalled) but he is able to reasonably ID the vehicle and a search leads him to your home a day later..........
BANG you're charged with running IMHO as the FLA case example is set.
Not too cool huh?
Its time to take take responsibility for one's actions.
Not "you made me do it............."
Preservation of life should include your own...............
And the FLA case sets a BAD precedence IMHO.

why would a cop chase a motorcycle at 100+ in an SUV? thats like when i tried to race my cousins race preped raptor on my utility atv thru some twisty dirt roads. what happened? i crashed doin 50-ish.

dont get me wrong, it sux when people die in ANY manner...
but what really "grinds my gears" is like on any of them cops shows after someone on a bike gives up on running with the keys in hand and the hands are in the air... why to the police tackle the people off the bikes?
i mean yea, if it were me...
ill pay my fines and do my time, but now the brandy new bike it just about totaled!
there has to be another way...

The charges are being piled on as hard as they can get them ...
Seeing what happened in Florida, a jury of his 'peers' is sure to make a couple of them stick.
If I had a bike and lived in the Syracuse area, I would just park it in the garage for the rest of the summer. Open season from the LEO community will be declared and no one will have a fair chance that area for a long time.
Election year coming up, the DA will try it in the media for all the exposure they can get. Justice will not be blind in this case.

Running from the po po is just a misdemeanor in NY max 1 year jail. Now they are trying to get a bill passed to make it a felony worth 3-15 years. 15 years comes if an officer dies in pursuit.
They even had the officers wife on TV supporting the bill last night.

As against running from the cops as I am that law sounds like it will encourage dangerous chases. They should pass one specific for controlling officers on unsafe pursuit.
What if your run away froma cop on foot and he falls and hits his head or falls on some object and dies. The consiquences are from his actions, you didn't make him trip. In my opinion the law should be to keep everyone safe. You chase a bike and it's going to go faster so will you. What happens when the a bystanding motorist gets tangled up in some bad outcome from a crash, or run off the road by a trooper going by at 140mph. I think the foremost issue here should be saftey.

The heart of the bullsh*t will be if we get to the point where the law for running from the police has a more severe penalty then if the cop shoots an innocent and kills them.

can completely imagine that happening. there is very little penalty-wise, that happens to an LEO when an innocent is shot when in pursuit of a "criminal."

Maybe the widow should file a suit against the shop that sold the motorcycle to the guy, and then one against the company that made the bike... (kidding...)
