    Rode bike home from track day and got a ticket

    So wasn't in the plans but a buddy of mine got a kidney stone and had to leave after the 1:00 session. Other buddy was doing 2 days so i had no ride home. Put the street stuff on the bike and headed south on 395. With 1.5 miles to go a CT trooper lit me up in the left hand lane. I pulled over to the right hand lane and he was still behind me so i pulled in to break down lane. Trying to think what i did, I was running 75 like everyone else, put the fuse back in for brake and tail lights, put number plate back on. Forgot to put air back in the tires but thats not it obviously.

    Took off helmet, shut off bike, pulled out license, reg and insurance. He said he pulled me over for passing on the right. He said "do you know you passed on the right" I said "no didn't realize it? so he said "i have it on camera". In my mind there was passing going on all day and passing a car on the right on the way home wasn't exactly in the forefront of my mind. So I said "I didn't realize it but if thats what I did then i didn't mean to." Basic and respectable conversation both ways.

    He came back with a $132 ticket and said its not considered a moving violation and therefore no insurance hit. I guess being programmed all day not to pass on the left in the kink area carried over to the ride home. Also said he could have written me up for 78 in a 65 but didn't.

    So i guess it could have been worse, but still out $132, unless CT has a good driver statute that can be used in this case?

    Seems like bullshit. I drive a truck and get passed all day on the right by people with much more important places to go than me. I would fight it.

    look up the laws. in MA its actually legal to pass on the right on a multilane road with restricted access, ie a highway.

    (4) upon a limited access highway or parkway free from obstructions with three or more lanes provided for traffic in one direction. Such movement shall not be made by driving off the pavement or main-traveled portion of the highway except where lane designations, signs, signals or markings provide for such movement. Violation of any provision of this section shall be an infraction.

    I find it hard to believe that "passing on the right" ISN'T considered a moving violation. I would definitely confirm that before just paying the fine and chocking it up as a loss. Cops have been known to be wrong before. Lol. He tells you it's not a surchargeable event and then come to find out later that it IS. You don't wanna look at your driving record in a couple months and have that WTF moment. Another thing: Maybe for a CT driver it isn't but for a MA or RI driver etc it is?? IDK.

    How passing of any kind is not considered moving?! So if this particular maneuver is a violation by the CT trooper then it is a moving one. Just IMO

    Looks like its no points on a CT drivers license (which doesn't matter to me as in RI we don't have points), but it still is a violation on driving history.

    I don't get how he calls it a non moving violation. Almost thinking he was making it sound better than it is so you just pay it and move on.

    CHAPTER 246* MOTOR VEHICLES

    Violations listed in those called out sections of the law count as 'moving violations' according to CT law. Passing on the right as defined in the earlier link therefore is a moving violation under CT law.

    I'd fight it.. I had a cop try to tell me something wasn't a moving violation but I could tell by the tkt that it was.. fought it and won. Told the magistrate that the cop said it wasn't a moving violation and they were completely confused as to why he said that... I know why.. cuz he was trying to deter me from fighting it... Losers

    I have heard a lot of folks talk of being ticketed in MA for passing on the right. And yeah, it's the two lane thing mostly. A friend of mine said his wife was ticketed for passing a car on the right, even though that car was stopped, and turning left in a lane where there is a left turn arrow: The implication being, she was supposed to wait for some other guy to turn left before passing... which is absolutely mental considering the flow of traffic in that area. (there are two lanes, it's not like she was going around him or passing in a bike lane)

    I honestly think there is just a lot of "we need new ways to bring in the $$$... what law can we over enforce??"

    It's true. And yet, the tickets are no less real. Like I said, one of the cases is a friend who's wife was passing a car stopped to turn left onto common street from Mt. Auburn street in Watertown MA. There are two lanes. It should totally be legal. Officer begged to differ. I have not checked up to see if they petitioned the ticket.

    To complicate things, I'm not sure it matters if its a moving violation in CT or not, because you're not licensed in CT. I think they report it to RI no matter what. And once they do that, I think that info eventually gets pulled by your insurance. And we all know that's the only thing that matters. Then the insurance company decides how much to steal from you.

    If I am reading correctly in CT I can send in the "complaint" marked not guilty. They will give me a court date. I go to court and meet with the state attorney prosecuting the case and often times a compromise is struck. If not then I get called back for a later date and the officer writing the ticket gives his testimony. Is this correct.

    As I play it over in my head I was in the high speed lane. Rush hour so both lanes busy. I see a sign for my exit (Rte 201 Hopedale Pond) I move over to right lane. Then I realize the exit is not for another couple miles. I move back to the left lane to go around some traffic apparently passing whoever was previously in front of me. Basically I pass a car in the right hand lane by using the left hand lane, but in doing so it causes a pass by a car that is in the left hand lane. Sounds hard to explain. Maybe I just explain how I moved back to the left due to congestion on the right to be in a safer area and that resulted in me accidentally passing the car on my left??

    getting a ticket for passing on the right is ridiculous. Just yesterday I was on 93s where a woman in a Mercedes was PARKED in the left lane. She didn't have tinted windows and kept waving at people to go around her. I would be furious if i got a ticket for passing that.
