So MA law presumes over 50% fault when a single vehicle accident takes place. thus, you get more insuance points. Last July i had my get-off on that infamous NESR ride. Insurance wanted to hike my points. I appealled. 3 weeks later I started law school. in Early April I finally got the hearing date. I did some research on the MA law, found some other decided situations that were similar to mine, printed out some public comments made on NESR by people who were on the ride with me that day, photo copied proper-stopping-in-a-turn-techniques from the MSF course manual, etc. etc...and sent all the info in. I couldn't actully attend the hearing b/c it was scheduled for the same time as an exam at school. today I got the finding of the hearing the mail;
"Upon review of the law and evidence presented...we find the appallant IS NOT more than 50% a fault, and the surcharge is not in accord with the SDIP policy. The board hereby VACATES the surcharge"
