    Vehicle Registration experts... question

    Sylwia bought an xt250... for the sake of this story, she will be owner #3.

    Title is a New York title and is in Owner #1's name.
    Bill of sale is some sort of Connecticut DMV web form (because Owner #2 lives in CT), but ONLY has owner #1's name
    Both forms are dated 4/2/22.

    Owner #2 never transferred the title... but thankfully their name is nowhere to be found on any of the existing paperwork.


    Anyone foresee any issues registering in MA?
    How much are we looking at for penalties?



    Just go to RMV and ask?

    Amazingly when I have questions like this I just email them, and I’m shocked that the couple times I have I’ve received a helpful response.

    Maybe try that, and maybe it’s a new thing since Covid that the rmv/dmv is actually helpful, trying to cut down foot traffic?

    Yes the chain of custody is lost between owner 1 and Sylvia by owner number 2 in CT by being negligent in both registering and having a new title generated in their name.

    I would go the VT route on this one as titles are not required on Motorcycles less than 300 cc.

    Just a good bill of sale from owner 1 would be needed and just leave out owner #2 ever existed .

    Owner #2 never did anything paperwork wise... didn't register it or transfer the title....

    My biggest question is whether or not the CT bill of sale will cause issues. I think not, but may be the source of some confusion.
    Second question is back taxes/penalties since it's more than 30 days or whatever the window is.

    As far as I'm concerned, I don't want MA to even know that there was a second owner if we can slip around that.

    Massachusetts will simply reject registering the bike and want owner 2 to complete the CT transaction and re-establish the chain of custody.

    Instantly thought VT but if the title just has #1s info signed on the back and room for yours I would just go off that. Forge a bos Incase they ask for it. Forget #2 ever lived.

    This happened with my triumph. I was owner 1. Owner 3 contacted me and I got him a new title issued in his name somewhat painlessly. I'd see if you can contact owner 1 to work something out before rerouting the title through VT.

    Sounds good. Thanks for chiming in, I was hoping you would.

    ... And I wish I had known about the paperwork.

    Any idea what the fee is? It's only been a couple of months overdue.

    Thankfully, NONE of the paperwork has any indication that Owner #2 even existed. Only weird thing is that the BOS is a generic form from CT.



    ... So as it stands, I'm thinking about taking the existing paperwork, swinging by the RMV and seeing if they're okay with the Bill Of Sale being a print out form from CT.... hopefully they won't be too suspicious.

    If they ask questions I think we'll just tell them that Owner #1 had just moved to CT and used that as a template.

    That sound like a good approach?

    A Bill of Sale can be in any format, it can be handwritten on a piece of notebook paper. As long as it contains the seller info, buyer info, vehicle info, etc, it doesn’t matter.

    CT DMV just provides an official form for convenience - I am in CT, but I usually use it so I don’t forget any necessary information by doing a handwritten one.

    I won't Google this, since you could just as easily, but when I registered the XC-W earlier this year - one month after the date on the BOS - the late fee for that ~$8K-valued vehicle was around a Jackson.

    The title fee in MA is currently $75. The law states you have 10 days, however there is no law about penalty or fines for missing it.

    Fees could be all over the place. There doesn't seem to be any rhyme or reason to it. I would figure sales tax off the stated amount, reg, title and plate fees then maybe a 20 spot for it being months old. They usually don't charge that though but they certainly can. The stated amount is what's going to be pricey. They will use the higher amount to calculate taxes usually and I'm pretty sure your stated amount is way higher than book value.

    Bos is fine, they don't care. I usually just use a VT one even when in mass because it's so easy to find and print out. The CT one is good too.

    Fees are well documented in MA. The only fee that wiggles is the NADA value and excise tax in your town.

    Late fee is very iffy as is the tax fee. Those can both be very large or small and make predicting the total impossible to guess until you are there. It's not like cut and dry VT. Absolutely not well documented.

    late fee is not documented because it does not exist. taxes are 6.25%. excise is $25 per $1000 of MSRP on a sliding scale. Fifth year and onwards its 10% of the MSRP.

    I think it cost me about $200 or so extra to register my FJ after being 3 months delinquent since the date of sale. I don’t think the 10 day rule will be much to stand on now as I can’t even get a reservation to title my WR until mid next week and I bought it Friday. Try and play the Covid card in some way to help out.

    similiar here in RI, I was 2 months behind getting the 690Duke registered due to VIN verification, got wacked with a $26 PENALTY for late registration / sales tax and a $8 "interest" on late sales tax. Apparently the state of RI is getting a SERIOUS interest rate on their tax dollars.

    Also saw this for the 1st time, "Motorcycle DOT Surcharge" $13

    Why is the BoS an issue? I've never needed one for MA RMV; typically just needed by the bank if getting a loan. RMV just needs the signed-over title. As long as the buyer-related info is blank on the title: you should be good. Unfortunately you'll be subject to the date & sale price that is on the title unless you can get Owner #1 to get a replacement title & fill it out again.

    I just went to the RMV to title & reg a private sale bike I bought over 2 years ago - back taxes was a punch in the nuts!

    Mass rmv has started asking for bos now. They never used to but the last few times I've had to submit it so now I just make sure I have one.

    I didn't bother reading the other responses.

    My suggestion, forge a new bill of sale using owner 1's info and signature with Silvia's info. Change date on back of title to "8"/2/22. Pretty easy with it being a 4.

    Honestly.... The number of times I've forgotten a signature here or there and had "run out to have them sigh it, since they're in the car" hard eye roll by dmv employee who let's you go sigh some shit on the hood of a car. They still always finish the titling and registration. Can u look up owner 1 on social media and send them a message some how? Hell maybe even go old school white pages?
