    Bradford motorcyclist's ruse fails to foil DUI
    Wednesday, September 22, 2010

    An early Monday morning anonymous tip
    reporting a man talking to himself on Chase
    Hollow Road in Bradford led police to charge
    Bradford resident Shawn Pape, 39, with driving
    under the influence -- the man's fourth.

    Pape, partially pinned under the rear wheel of
    his motorcycle, deflected officers' questions by
    pretending to be asleep on his bike's gas tank,
    according to a statement released by Vermont
    State Police on Tuesday.

    Pape refused field sobriety tests, but technicians
    at the Bradford barracks later that evening
    determined his blood alcohol content to be 0.209
    percent (0.08 percent is the legal limit), the
    statement continued.

    Officers escorted Pape to the Northeast Regional
    Correctional Center in St. Johnsbury for lack of a
    $5,000 bail, police said

    How does that even work I think I need a diagram to explain how you could be "partially pinned" under the rear tire yet still able to fake (or at least attempt to) sleeping on the gas tank. This guy was hammered.

    There is a guy in VT who last year about this time got his 16th DUI. VT sucks for enforcing DUI laws... i'll stop my rant there.

    I can damn near hit that guys parents house from here with a baseball. Reading the above isn't really surprising considering he's had other run ins with the law and was on house arrest for a long time. Then the local sheriff started doing his drug addicted ex-wive.

    G'damn I LOVE these small towns in VT

    3rd DWI in VT gets you loss of license for Life which = 3 years of proven sobriety to get it back.

    He must be a seasoned drinker - 0.209 and still able to get the bike off the kick stand, let alone his leg over it!!! They'd find me passed out in the parking lot.

    Unfortunately - 4 DUI's isn't really that impressive in VT anymore. They have tried confiscating the cars - they just drive junk that they don't care about losing. License suspension - kind of hard to take something you've already lost. Raise the insurance - they just drive without it. Prison time - A decent lawyer can keep this from happening...

    .209 is drunk but not that passed out in a parking lot drunk. Had a pocket breathalyzer and blew a mid to low .2 and was drunk but no where near falling over wrecked and I am not a heavy weight drinker.
