lawyer help

ok, so heres the deal. a few weeks ago a friend of mine and her husband were in a motorcycle accident that was TOTALLY NOT their fault. they were sitting in traffic when a vehicle from a parking lot across the street tried to cross 4 lanes of traffic plus a left turn lane to enter the parking lot on their side of the street. they were traveling approx 20mph and the lady just t-boned them

at first it was bad but not horrible. he was rashed and bruised but ok she had a shattered ankle and needed surgery. after 3 surgeries and countless pints of blood she was transferred to Darmoth hitchcock for skin graphs. the skin graphs wouldnt take and now they are taking her leg from the knee down.

her husband is kind of an idiot and has a lawyer but im sure its not the kind that they need. im looking for some help on not good but EXCELLENT lawyers. shes 33 and has a 7 YO little girl and a mother with alzheimer's that she takes care of. i dont think they are looking to get rich off this but i think its inevitable. if anyone can help recommend someone it would be greatly appreciated. Sedition... if you know anyone.....

The insurance companies know a certain percentage of claiments will die of other causes before they have to pay.

Additionally they are making interest on the money they hold on to.

This is real and a better lawyer might do more but it will take like 6 years.

Even your own lawyer wants them to make a no court settlement get paid a little, then he's on to the next one.

A prolonged court battle is never what the lawyer looks for.

Secretly there is probably a number for leg amputating.

Also remember to find out how much liability insurance the hitter has. She might only have like 100,000 coverage and no other real assets. Then her company writes the 100,000 check and they are out of it.

It is almost not practical to seize other assetts other then her 1/2 of cash in a bank.

Getting a good PI lawyer is the key; they should be able to take care of everything.

This isn't a difficult PI case. I spent 3 years working as an office bitch at a PI firm, and someone losing a limb is enough for any PI lawyer to develop dollar signs for pupils.

The best advice I can give is to look in the yellow pages, find the biggest ad for Personal Injury Lawyers, and give them a call. If they can afford that ad, they've been successful, and they take the same percentage (1/3) as some podunk douchebag lawyer.

Bear in mind that the party being sued will most likely be the at-fault driver's insurance company, and they will be used to being sued; that is where having a big-name lawyer comes in handy. The adjusters will usually dispense with the usual BS.

Awful sorry to hear about this whole thing.

Working in the Litigation Department for an insurance company, I would advise to stay away fom the TV lawyers, they are looking for quick easy settlements, no court battles. Your frineds should see what the at fault party has for liability limits, if they only have $20,000, nit worth getting a lawyer, send the insurance company a demand letter and they should fork over the minimal limits in a heart beat for that ankle fracture.

Depending on how many surgeries and to what extent the disfigurement is on the scarring, the lady with the fracture could be looking from anywhere from $30-$200k as a settlement.

The reputable lawyers will not be on tv, the radio or the side of a bus.

Lastly, insurance companies do have lists that give a suggested dollar figure for certain injuries like amputations, they are a guide only, each case is different. Adjusting a bodily injury claim is atually a very hard thing to do as they are not black and white but greyish, as everyone has a different conception of pain.

Hey QB

I'm not putting you down , just the man you work for ...
If it was you who was injured.. You may understand why I hate the insurance companys .. They are only interested in the bottom line ... Business is business . The real problem is law & the insurance companys , are big business who own the us by lobbying the laws.. The little guy never makes out ..
My injurys are legitimate . Like I said I dont care they are going to pay .. Cause i will have my day in court ..
I was run over on my bike , by a stupid ass who cut the turn .
I was @ a dead stop , on the stop line . She got a ticket ..
For the life of me, I don't understand how she did not see me ..
The insurance company only pissed me off .. The way i see if the adjuster was @ least nice . It would have went far ..
But there client was @ falt .. So all they did was piss me off not smart IMO .
Please respond I would like to hear your spin on why they would do this .............
PS the way i see it they wish they made me so broke I would have to take the first offer ..
NOT this boy !!!!! Also like i said i'm lucky that i have health insurance . I also notice the dr want more $ cause im sueing ..
WTF do they think .. To me thats not right .......

What an absolutely ridiculous thing to say.

PI Lawyers (beet: yes, they are the scum of the earth) want a bigger settlement for you because it means more money than them. And at the end of the day, the client makes the final decision as to whether or not to settle, so the argument that the lawyer will be looking for a "quick easy settlement" holds about as much water as the surface of my desk.

Successful lawyers spend money on advertising.

It wasn't a fracture, she is losing her leg from the knee down. If I were in those shoes I would laugh my ass off at a $200K offer.

Will get the name of the lawyer that my boss used when his father had the same situation (loss of leg due to an inattentive driver). Did very well by them and even gave them the choice of how hard they wanted to drive the nails into the driver....

Just to amplify...

The Insurance company only has to pay the maximum of her coverage. period! that is what she bought..

I have a 1mm umbrella but most do not...

If the hitter has minimum insurance and no assets then regardless of courts etc. you will get 20,000 that's it.

If you have a lawyer for the 20k he/she may get 1/2 you get the rest.

Then the medicos can go after your assets to pay your bills

Have a nice day

beet, in car accidents the insurance covers medical, the lawyer takes 1/3rd but the doctors don't get anything. You can collect pain/suffering and so on if you are permanently disfigured, any scars etc, or you have a total of over $2000 in medical bills. The severity dictates the settlement. There may be room for a civil suit as well. Was the driver cited at the scene?

When I got rear ended at a redlight about 2 years ago, the lawyers took 1/3 of the settlement, and I had to pay the balance of the bill to the chiropractors and physical rehab facilities.

I hope your friends pull thru this...I'm sorry to hear she lost a leg because of a stupid driver.
