Most states have a self defense clause, how ever your life must be in eminent danger. If you shoot some one in the back while they are running away you are considered a vigillante and will be charged accordingly. It's supposed to keep people from becoming Judge, Jury and Executioner.

As far as I'm concerned Bienvenido should have been allowed to rip that asshat's spine out through his own nose, mount it on his wall and use it for a dart board. But that's why we have due process, so people like me don't go around shooting every idiot that pisses me off. he was charged with a crime because he shot the thief in the back as he was running away. the cabbie was no longer in danger, the robbery was over. Deadly force is not an appropriate action at that time. I think it would be different had he shot the thief while the robbery was being committed and he felt that he was in danger of getting killed.

if someone has a gun to your head and is threatening to kill you, then lethal force can be applied. However the level of force applied must be comperable to the threat. if someone throws sand in your face, you can't haul off and pump them full of lead. At that point you'd cross the line from victim, to aggressor..

When it comes to the law they can only do so much. They can't catch everyone... and like i said these guy's get off on some bullshit technicallity 1/2 the time anyway. When your stuff get's stolen let me know how you feel then. Besides ive been around alot of cops in my day and half of them were worse than criminals. My uncle is Thomas Doherty he used to be a Medford cop who just got out of jail for Attempted Murder, Bank Robbery, Drug Dealing and a bunch of other shit i can't even remember. I knew so many cops that did drugs, stole, lie, beat people and the list goes on. So excuse me for taking things into my own hands. But if someone messes with me there gonna get it back. An eye for an eye. Another thing nobody made those kids smash those windows, steal my shit and who knows what else they did that night,...they got what they deserved.

I'm not saying that i disagree with the actions you took. I hate Thieves as much as you do, I just didn't think it was smart to post up about doing what you did. I know for a fact LEO's have gone to Massdriven.com's forum and used members posts against them in court. It was also suggested that LEO's visit the "rides" section bike forums to learn the routes and patrol them more. I have also had first had conversations with LEO's who have told me they go to forums and sites like myspace looking for people who post up pictures and stories about illegal stuff and use it against them. I was just trying to give you a heads up.
