MA car/lemon laws about selling a pieceLemonlaw online says that if it fails inspection (but not from beating the piss out of it) and it costs more than 10% to fix it, the buyer is entitled to a refund. But from word of mouth, I've heard anywhere from $500 to $700 as being the cutoff where the seller isn't liable or responsible for the condition of the car. In addition to being sold "as is, as shown" (on the bill of sale), if it poops out, it's the buyer's problem... So what should I know about selling my '91 ford ranger? I'm also including this in the Bill of Sale: "The Seller expressly disclaims all warranties, whether expressed or implied, including but not limited to, any implied warranty of merchantability or fitness for a particular purpose. The Seller does not assume, or authorize any other person to assume on the behalf of the Seller, any liability in connection with the sale of the Motor Vehicle." |

MA car/lemon laws about selling a pieceI've put that on the bill of sale before... something like "...The buyer understands that this vehicle is being sold as a parts vehicle and that in it's current state, the aforementioned (Insert vehicle here) would not successfully complete a Massachusetts safety inspection. The seller is not to be held accountable for any mechanical defect, releasing Bhavesh (<-- preferably real name there) from any warranties whether expressed or impied." I've sold many a shitbox in my day, and if the person understands what they're buying and doesnt really plan on bending you over later they wont care how you word the bill of sale. This is what I remember from the last POS I offloaded- They new buyer has 7 days from date of purchase (the date on the bill of sale and title youre signing over to him/her) to get the vehicle inspected. If it fails, and you dont have a parts vehicle clause in your bill of sale, the new owner has 14 days to present you with a written explination from the garage that failed it. The old owner (you) would be responsible for the repairs. If the vehicle they bought, whether from a public or private party, goes into the shop for the same problem more than 3 times in a period of 90 days, and the mechanic deems it NOT driver abuse, then the lemon law can take effect. |

MA car/lemon laws about selling a pieceI think anything under $500 you don't have to worry. Just make it very clear it's sold as is. I can't believe someone buying a car for less than 1k would try and get you to fix things. |
