Bad code in breathalyzers?


It's unconstitutional. I can drive fine while hovering around a .10
Things start to get a little fuzzy around .12 and then it gets kinda squirrelly when I get up to about .14

I always wear my helmet though!

that's the problem, an error in the machine can make someone who hasn't had a drop of alchohol a convicted drunk

several years ago, my older brother was arrested for DWI cause he had MS but didn't know it yet

I'm against drunk drivers as much or more than anyone, one of my grandchildren was killed by a drunk driver 12 years ago, but I am more against wrongfully convicting someone of a crime they didn't commit

Part of the reason you absolutely refuse to take a breathalyzer. I would refuse even if I didn't have one drink.

implies consent does not mean breathalyzer, you can do piss or blood test that are more accurate, they also need probable cause, although cops lie there way thru that

my friend had one of those personal breathalyzers. one time I had 2 beers & a redbull and blew a .4

then we went out to the bar. crawled back around 2am and I blew another .4

I think the second one was more accurate though.

kb, in ma and ri it us a bit different. The key is to deny both the breathalyzer and the feild test....you will lose you lic for 6mos. but the chances of a DUI conviction drop significantly when they do not have either to use against you..

but beware the shit hits the fan if you refuse them and get convicted of DUI...


buddha, i'm pretty sure .4 isnt accurate either....unless you rushed him to the emergency room for alcohol poisoning or were cleaining up gallons of puke lol.... .4 is way high....

In NH, you have a choice of Breathalizer, pee or blood, they need probable cause to require it, if you not driving erradicly, slurring words and didn't do the stupid field sobreity test, they have no probable cause

Never, I mean Never submit to the field sobriety test, it can never help you, it's only a way they build up evidence against you, any minor ear infection, alergy etc can mess with the balance in your inner ear

Nor does cooperation help you

the few times I have been stopped, I refused to step out of car unless they first arrested me

the one time they arrested me, and I stepped out of car, I refused field sobriety test and requested that I be able to speak to my attorney before I submitted to a BAC test

suddenly I became unarrested

Ok I am the uneducated idiot!!! I got porked by not taking the breathalyzer and lost my right to drive for 5 years when I was 21. 3 for refusing the breathalyzer and 2 for aggrevated DWI and that was after 1500 for some shitbag lawyer. I guess I am a retard.

My knowledge in LE is going up since I work for a dept now.

If you refuse a PBT then you are automatically guilty, you can have blood drawn as well to more accurate.

They use a real Intoxology machine that is very accurate and you have to be trained to use it. The field ones are just to get a reading to see if you might be intoxicated, that is why it is never used alone.
