Still no word. One problem I have is that I have to pay off the wrecked one before I can finance another.

By that time, this sweet ride may be gone.

Not sure if I'd have debt to income ratio issues. (Mortgage, car and been on current job only 3 months)

They did call but I was outside, so I got voicemail. The salesman said they have 3 07's. 2 silver, 1 red.

Well, my dreams of a R&B bike are gone. Best Cycles only has 2 silver 07's left. Same color that I have now. One with flushmounts and one with standard front turn signals.

Take your time, there are going to be tons of left-over and lightly used bikes for sale this winter. I'd pay off the other bike and wait a month or two, you'll probably be pleasantly surprised.

You just got financed on the last one. Submit the app to the same company and make sure the loan officer knows the open loan is totalled; awaiting settlement. They should issue a conditional approval pending payoff. The total loss letter would help if you have one yet.

and go there and check the storage room underneath the car showroom, they always have stuff down there. Sometimes it will sit there for years and they forget about it.

Have you checked on the insurance buyback? i think Degs knows how to get it cheap and I might be interested at that price plus your finders fee.

Re: Well, it's official, the 1K is a total loss

    Well, here's an update . . .

I called Commerce on the payout and the adjuster said that the payout is going to be the cost that I paid for the bike, plus the sales tax.

Unfortunately, when I added it up, the amount they mentioned would not include any of the upgrades I made to the bike, if I were to buy a new one. So, basically, I'd be out the cost of the accessories. So, I wrote back saying I was rejecting the payout.

    Is that how it's done?

As for the gear, I was told I had to make a claim against the other driver's policy, since she was found to be at fault by Commerce.

Should I get an attorney for this?? I know I will also be dealing with the other driver's insurance for pain & suffering and don't have a clue as to what that amount should be.

I really feel alone at this point.

chuck what mods do you have into the bike again? Corbin Seat, Lights, Windscreen, Rearsets, and Fender Eliminator?

You can pick that stuff up cheap again if it comes down to it.

Def go after her insurance for the gear. Not sure if you need a lawyer for that stuff though.

That's bullshit. YOUR insurance company has to take care of all that for you as far as I'm concerned. They insure you and you should have legal coverage in there also. You shouldn't have to go after anyone. you made the claim to your insurance company, you are not at fault. Commerce should do all the legwork to get the money from the other driver.

You nailed the mods, plus I had Stompgrip on the tank sides and a Stompgrip tank pad (those total $80, so they're no small beans)

I just hate to have to dish out the dough for all these parts again.

This doesn't seem to be their take on this.

Not sure what to do now.

Is there anyone out there that has legal expertise on this type of matter?

I have no experienc with bikes but I had an accident with some douche (and my insurance was Commerce), I basically had to badger them and tell them they were wrong/underestimating things SEVERAL times before they gave me a check that was fair to me. It sucks but it will probably just consist of you badgering them until they finally realize you are not an idiot and what what is rightfully yours.

Is the other driver insured under the same company? Economy sucks, insurance companies will try to screw you.
