A few weeks ago merging onto the highway my front tire hit some debris causing it to kick out. Thus totaling the bike.
The insurance is claiming I;m to be found more than 50% of the accident.
I operated the vehicle in a safe and reasonable manner. If a car hit this debris a flat tire would occur as a result . A bike hitting it would cause it to crash.
I wasn't speeding above the speed limit nor operating the motorcycle in a non safe or unreasonable manner.
Has anyone appealed it this situation before ?
If I had been driving reckless and this happened then yes it was my fault. The point system is set up to categorized aggressive/non safe drivers based on their behaviors correct ?
Yes I have and won! My rear tire blew the bike fishtailed wildly and I totaled it. I appealed the surcharge and the insurance company had to remove the points. It did tale a year to get the hearing but it was worth it.
I tried and got fucked over with a +$100/year "at fault" sur charge. I hit a rock mid corner with my front tire, crashed, bike totalled and I lost.....

i am in the same shoe as you. i just totaled my bike 3 weeks ago on a slippery street mark. they claimed that i was more than 50% at fault. i am thinking of appealing it.
