wait, is this a criminal or civil ticket?
Don't try to fight the radar. The officer (or representing officer) will have the officer's training records and calibration data with him and that'll be the end of your fight. The officer (or representing officer) will probably meet with you before you enter the courtroom. That's where he'll expose the information he has and ask what you intend to plea. Tell him your plea is a "1 year continuation to dismiss on the grounds that you have a good driving record and this was an isolated incident." If that doesn't work you can modify your plea to include attending a traffic school session during the year as a refresher.
This basically means you have to play nice for 1 year from your court date and the charges will be dropped. If you get another ticket in those 12 months they will prosecute both tickets at once.
Appear in court with anything to boost your safe rider credibility. MSF card, ERC card, Track Day receipts, photos of gear and a printout from your insurance company proving a good driving record.
In my opinion, that's your best shot but there are no guarantees.
so i had my arraignment this morning....they asked for my plea and i asked to speak with the prosecutor to see what they had to say (the cop wasn't present and some chic was representing the state)....she said if i plead guilty or no contest it would be $600 in fines and 30 days loss of license haha so needless to say i just plead not guilty (which is what i was going to do anyway if she wouldn't negotiate).
now for trial on 9/24
christian cronin was also in there haha (he races up at the track)
get a lawyer that can walk to the court and does traffic stuff everyday
Yeah, i would have to agree with you.
I have been in similar situations and can tell you your best bet will be to fight it to the end.
GOOD LUCK!
so at your next court date, worse case is you lose and still get $600 + 30 days lost license. not bad. :poke:
thought you racers stick with the track only. guess everyone rides on the street sometimes. even all the assholes that's been giving me hard time. :chair:
for someone like me, track around here just isn't economic.
i still ride on the street all the time...its just not as exciting as it used to be haha
I'm not TOO worried about it. I do want to talk with the cop before the trial if i can. I'd like to see if we can negotiate something, and if not, then i'll go in with guns blazing (fighting the ticket, not literally :P)
Was this a "must appear" ticket, or one with a fine schedule to mail in and pay or request a court date?
Either way you have time to prepare for your court fight, which is a good thing.
Either way you could be the guy with the 120 MPH problem.
At least we know this happens "regularly", the 120 MPH........... :spank
You may want to call around for a traffic / DUI attorney, but any attny who pleas, is doing exactly what you can do, and additionally, if things look bad you can always testify to a slower speed. <25.
The partial issue I have is the certification the SP does on its radar units.
Its NOT a disinterested third party, like Gore Labs or Law Enforcement Maint.
There are many ways to beat a radar or LIDAR ticket with the right questions and records request.
ANYONE can plea this down to a 15 over ticket. Its VERY easy. Don't pay an attorney to do it. Pay / get an attorney to win your case & save your driving privilege.
I can help on some items.

I'd skip the dealing with the officer, he has no pull now the DA / ADA has the ticket and is prosecuting the case. You can talk to him to plea to the DA, but go directly to the source.
You can cross examen the officer in the court case trial if you really want to talk to him.

I got operating to endanger, No safe lane change and Fail to signal on Wednesday July 11. The Mass Statie gave me a criminal application that I need to go to court. I will also get my license suspended for 30 days because it's my third ticket in one year. I keep telling myself to slow down every time I ride. It's too hard. :sad2:
I was charged with reckless driving in NH. 600 dollar fine and loss of license for 60 days.
Yeah.........that sucked!
After that experience I have lost faith in the judicial system.
oh and don't speed in Merrimack, NH............bastids! :chair:
I used to live right near Fidelity. My violation was driving on Continental Blvd.
WATCH OUT!
They even pulled me over for going 41 in a 35.......i got a warning
just had my trial this afternoon....case dismissed
cop never showed, prosecutor had mismatching information on the files and no way to proceed
sweet!
wow. you lucky.
did you pay the fine anyway just to be a good citizen? :poke:
