For the 2.56X10 to the power of infinity I am not looking for advice on what i should or shouldnt do with the bike. My deductable is 500 bucks. The plastics on one side of my bike are double that if i want stock. The bike is technically totalled which means I owe nothing, not even the deductable.
So besides not knowing what you are talking about you have contributed no information to my initial question. One person has answered my question. I mean for f**ks sake i know this is nesr but no one can give me a "my buddy, blankity blank insurance company, no problems 100% covered, possible contact info" in addition to their bullshit?
If i was the insurance company and i told you that you were covered and you had an accident, you would expect coverage correct? Well i do too.
I hear ya bro, its tough getting answers around here
Anyways, I'd personally just take responsibility. Insurance wont cover you so just pick up some extra shifts at work. Kinda silly for you to be racing such a nice bike.
Ebay has some cheap parts

Re: If you have been down at a trackday, and covered by Mass. insurance...
I have paid enough into my insurance to cover my bike twice.
I wouldn't feel guilty if I were to use it if I crashed on my bike.
However; i've never crashed on a track, so my comments are irrelevant.

Well not withstanding all that stuff, I still dont see the problem using insurance. Its not like this was excluded and he's trying to commit fraud. And really, whats the point of insurance if youre not gonna use it.

I agree I did walk away scott free compaired to you,but thats because i sold my soul to the devil to be his rider... you went through insurance yourself, but because my accident wasnt as severe i should suck it up and let the insurance company give me a dirty sanchez...yea,not gonna happen....hoping my sarcasm detecter is just failing here :twofinger

Update:
The claims woman (C U Next Tuesday) never told her boss(person who denys people) about her convorsation with my agent. I guess she expected my to just accept that they werent covering me.
Long story short, called her up, and very politely asked for the person "in charge of her". Talking to her boss(who is the person I should have been talking to in the first place)I started to get the bosses explanation of why I was denied. He explained that when I am on a track dressed like a racer, that I am basically racing. Also informed me that they have had a large number of problems with other clubs, like the "porsche club" trying to get their race set up cars paid out with insurance so they have been putting their foot down...
I said "so if i am on the track I am automaticly racing?" He said something like as far as the insurance is conserned unfortunatly yes.
The turning point:
I told him I am prepaired to take this as high up as i need to either in the company or legally based on the insurances failure to act in good faith twords me. He politely told me that he believes the law is more on their side then mine. I asked him as a person how he could sit there and tell me that I am not covered when I was told I would be. He didnt have a clue as to what I was talking about. We then had a long convorsation about my suspicions that his underling had not been properly informing him in all aspects of my case, and was just mostly rude and unhelpful from the get go. After my rant about how much his employee sucked, I told him that my agent had a long talk with her about this basically being his fault for not seeking clarification before telling me I was covered. He asked to place me on hold while he confirmed this with my agent. Sure enough he gets back on the phone and tells me he needs to talk to some people and that my agent confirmed what i had told them.
My agent calls me and tells me he still cant believe they are playing hardball and that after finally talking to someone that has pull I should finally be found covered.
So i have to send in a notorized statement from myself stating I was gaurentied coverage from my agent prior to the event. Hopefully that is the last hoop i have to jump through.
/rant off

This from the guy who suggested committing insurance fraud earlier in the thread?

Re: If you have been down at a trackday, and covered by Mass. insurance...
IMO, if you take the plate off your bike, you should no longer be insured.
Hopefully though, your insurance company will back what its agent said it would.
(so, when doing a track day, keep the plate on)

Most require you to take it off.
And insurance companies only do 2 things.
1. Take in as much money as possible
2. Pay out as little money as possible.
I think if they spent 1/10th of what they do on advertising we would all be paying about 1/2 of what we do now. Thus, I dont give a shit about them.

Theoretically (LOL) If a duly authorized agent makes a verbal statement it is binding as a contract.
Do wacka do wacka do

thats the big thing here, my agents not even going to get a slap on the wrist. He will be told to make aware that arbella doesnt pay out for situations like this in the future. I would have never went to the track on a bike i still owe money on, if i knew i wouldnt be insured. So if he said hell no wordtooyomamma we don't cover that shit...I would say "O Rly?" and he would say "Ya Rly" and i would have never gone to the track on my 09 gixxah :)

And you would be a poorer rider for it. :D I don't think insurance coverage should stop you from going to the track. It is alot safer and better monitored than the street and if you are not an idiot you have LESS of a chance of an accident on the track. (alot of street factors are removed) IMHO.
Thank god your agent said you were covered and is sticking to his word. :beerbang:
