Legal Car Theft / Dispute?
Ok, so when the lady friend was with her ex (her sons deadbeat father)...he cosigned for her car. Shes the primary on all the paperwork but obviously both their names are on it. Its her only vehicle, which she obviously needs to get to work and get her son to daycare, etc.
So last night, while I'm working on the race bike she calls me in hysterics. Apparently like 15 minutes after she got home, he was waiting in the parking lot and stole the car from her. Left all her shit in the strewn across the parking lot, and sent a text message basically saying that hes taking the car back. (he has his own car mind you). He's pretty fucked up, and thinks this is his way of "teaching her a lesson"....and honestly thinks that if she doesn't have a car, it'll help his case in court or something. even if the reason she doesn't is because he stole it back ha.
So I went over there, her mother picked up her son to take him for the night....and we were trying to figure out what to do. We went for a drive and happened to see an LEO so I asked him for advice, he suggested a Civil Standby and go get the car (which was now in Weare, NH at the kids house as we found out). So we tried that....the Weare PD basically said theres nothing we could do except take him to civil court and work it out there....the only issue is obviously what does she do in the mean time. We didn't go pick up the car last night ourselves because the cops basically said dont do it or it could be trespassing or something. They did mention that he doesn't have any legal right to deny her access to the car....which he is doing.
So as I type this apparently the kid is going to the bank to "refinance" the car and get her name off of the title and loan (he actually thinks he can do that haha). The kid is seriously f'd up, he thinks he is doing the right thing to get custody of their son ha.
I don't want any of the "told ya there was too much baggage" bs.....We've gatta figure this out, I know there are some LEO's on here...maybe anybody else that has some ideas on how to go about this?

if she is already involved in a Custody case, Does she already have a lawyer?

yea shes got a call into him already. At the moment there isn't an open custody case, they recently settled but he (the father) wasn't happy with the outcome.

One of my friends went through this EXACT same thing recently.
Her ex stole the car and sold it.
Guess what. She got HIS car in the court battle. :lol:
Advice.
Put a restraining order on the guy.
File a police report about the stolen auto. (something so he can't sell it)
Get a lawyer on the case
DO NOT sign the car over to him.
Take the high road even if it is more difficult.
She may have to get a rental for a little bit but this will not look good in court for him.
(He is trying to make it harder on her)
You might want to go take the car back and such but let the authorities handle it.

apparently its taken care of...i did some research and asked her if the loan paperwork and the title app said "and" or "or" between their names....it was "or".
she and her dad refinanced the car and took his name off everything...they're waiting for it to go through now, and she set up a civil standby for 5:15 at the police department to get everything back.
so i guess it'll all work out anyway haha

Well, if the car was legally in her / her fathers name when he took it.

this kid's mission in life is to either be with her, or make her life miserable.
you should hear the shit he says about me (mind you he doesn't even know me, but he tries to convince her he does). Last night he even sent her a text that was like "have fun with dirtbike boy. you know i have friends that race in the 250 and 125 circuits too and they all say he's a douchebag" or something like that.

apparently it was a no-go on the bank to refinance with her dad...Mark (the fucktard) now has the car for good i think....heh...
good guy, leaving the mother of his kid with no way to get to work, get the kid to daycare, etc....

still look at the courts and show that the payments have been made by her.

good thing to look at also that might hurt her is did they have a joint checking account? do the checks have the 2 names on them?
if not have the bank pull all the payments that she made and show it when it comes time to go to the judge. if he keeps the car have her name removed and you want to payment that have been made paid back.

i think thats pretty much her plan...though i'm not sure if she was sayin she wanted the money back out of anger, or if she realized that its a legit thing to ask for (if it is?)

would not hurt to ask at this point. well if needed my car is sitting in my driveway and up for grabs as the bike will be out the rest of the week and the wife is home from work for the week.

haha appreciate it. i told her that she could use my truck for a few days and i'll just take the bike...at least it'll get her around.
