    4th Amendment SCOTUS Case Involving Motorcycle


    Supreme Court limits warrantless vehicle searches near homes

    So the police were looking for a someone on an orange and black motorcycle that twice eluded them via high speed chases. They located the bike via Facebook, went into the driveway at the suspected location, lifted up a tarp, and discovered the offending motorcycle, which happened to be stolen.

    Hmmm, I would have to go with happy. I don't like the idea of someone, cop or otherwise, rooting through my possessions. If they suspect something, as they did in this case, it shouldn't be that difficult to get a warrant. I now yield the floor to whomever desires to tell me that my opinion is the incorrect one.

    I guess I just assumed you had an opinion, so you were bringing it up. It's a weird situation, but I'm generally always in favor of restricting police power. So, same.

    Yeah SCOTUS the legislature of blue states have recently passed MANY unconstitutional gun laws but helping this criminal is what they do

    We should absolutely be protected from these kinds of searches.

    If the cops have reason to believe they have located the bike in question, they can present their evidence to a judge for a warrant.

    This was an interesting case because the police had overwhelming probable cause and therefore it was super easy to get a warrant, yet they were too lazy to get one. With today's technology they probably could have gotten one in literally minutes.

    I wasn't surprised the SCOTUS ruled overwhelmingly against the Virginia police, to me what was surprising was that this went up through the Virginia courts without any problems -- the state and its courts don't seem to have any problem with warrantless searches. Maybe they should start giving the Virginia police red coated uniforms.
