The scooter jumped into the path of a car moving much faster then it. I dont care whos at fault in an insurance scenaro, id rather not be run over. Would be like me not braking every time someone merges on top of me, or takes a left in front of me. Yea i would win the lawsuit but im not fucking stupid enough to put myself in a physics problem where the bigger object usually wins.
