You also have to realize that you are in NH which is much different than MA.
as far as insurance regulations. He is entitled to coverage and he just needs to get to the right person.
I would call the attorney General's office with a copy of that paragraph talking about non timed event yada yada yada and open an investigation. One call from the AG and they'll play ball.
Not to mention I would start a blog alerting fellow riders to the poor treatment given by that insurance company.

as others had pointed out before, try to get a letter from your trackday organizers saying it was not a timed event or a practice session for one, instead it was a rider coaching/learning session aimed at improving riding skills for better control on the regular streets and such, that may have the most impact along with your agents word that you werent in a race/timed event.
Insurance will try to deny the claim any which way they can. Recently my bike was involved in an attempted theft/vandalism. The claim was for theft/vandalism and not collision. My estimator at a local shop here in everett (total douchebag btw) got to see a couple pics of me at a trackday. He told the insurance adjuster/company that the bike was involved in "racing activities". Eventhough the claim was just for theft/vandalism, the company initially denied the claim saying it was a race bike. After my agent talked with them saying it was a riding school, they approved the claim finally.

At the end of the day, whatever is printed on you policy is the one that count. Most policies are very specific and they don't really care if it is a school or a picnic. If you touch the hot pit you are on your own, (however there are exceptions such as if the vehicle is used in a parade on the track depends on insurance companies).
One more suggestion, if anyone committed insurance fraud. Don't tell anyone, don't say anything on an open forum, don't tell your friends, don't tell your wife, don't tell your dog. In this faceboook day and age it is so easy to trace it to the person, whoever that knows the truth might have to one day obligated to tell it to a judge.

Oh, and for the record...I know you were addressing someone else but I have been in accidents and paid the damages myself and not called the insurance. Oh and the pipes broke in my house (my fault) and damaged the entry and I did not call the insurance company either....before you judge or say to know something...you might want to open your mind.

Not to be a dick about it....but I'd say hit up ebay and fix it yourself. I bet that you can get it fixed up for under what you'd pay for your deductible. Stock plastics and clips-ons are easy finds. Think about the time you've spent arguing with them about this....and in that time you could have fixed it up and been back on the road. Plus, in the end you'll have a bike without any claims on it.

For the 2.56X10 to the power of infinity I am not looking for advice on what i should or shouldnt do with the bike. My deductable is 500 bucks.
