We just moved out of an apartment and the fucking scumbag landlord is trying to deduct general cleaning of the apartment from our security deposit. a total of $180.

it's called cost of doing business, asshole. We're drafting a 93a letter now. We'll see how he responds to that.

we were there for 15 months.
apartment was clean when we left. none of us smoke.

we have access to alot of attorneys because of our work, and an attorney has already said it was BS to deduct for general cleaning that needs to be done whenever a tenant moves out.

I hate landlords..We are renting until we find a new house...And when we moved in we had no heat or hot water due to no oil...

Thye tried to charge us to have the filter cleaned and the lines bled..Like its out fault there was no oil..

    yup-
he fucked with the wrong people. Apparently he thinks we are like every other of his low-life tenants and will just give in. We spent the day researching Mass. general law, and will have a nice 4-5 page 93A letter for him to respond to.

If he is a realtor then 93a will mean something, otherwise it will not. I agree with you that the charge is bogus and he probably does it to everyone.

    Good luck

I had holes in the walls when I moved out of my last place and the slider screen needed to be replaced and we got the whole thing back plus interest. That sucks man. They shouldn't take out a cleaning fee since they have to do it anyway.

i still haven't got my security deposit back from my last place..been leaving messages with the woman. she checked the apartment when i moved out, and my mom helped me come clean it and she is super cleaning lady. the land lady said the floors were sticky, since we just mopped them, and said it would be a $10 charger per room if we didn't redo them. i hate renting!

I have heard that if they keep the deposit that they have to give you a detailed invoice of what the funds where used for. I live in NH, anyone familiar with NH laws?

Yes..They have to break it down for you in writing..Also they can't charge you for basic cleaning. It is understood that landlords must clean between tenants anyways..I just looked up the laws online recently.

    Hey Mike:

As part of the trial strategy, you need to subpoena his tax records, cause I bet the ass isn't declaring all the income from the rent to the IRS, then you rat his ass to the IRS and watch the shit fly. Also, check the zoning laws and make sure he is in compliance you could brreak his balls with that too. My neighbors have a large one family home that is divided into three apts, that is against the zoning laws, what was your place like?

I agree he shouldn't try to stick you with a fee for General cleaning.

But did you try just calling him and asking him to remove the charge before spending a whole day reviewing Mass. general law.

Most landlords would rather forget about any move out fees/charges for damages than deal with courts & unhappy ex-tenants. Any Landlord with common sense knows the Tenant always has the last laugh.

Unless your Landlord is dump as well as a scum.

It's been quite a while since I've rented. But it used to be (in NH) that if they kept the deposit for REPAIRS they have to provide you with a detailed invoice and any bills/receipts for said REPAIRS. The law used to state (again, it's been almost 20 years since I've rented) that as long as you left the place in the condition it was in when you moved in, you could NOT be charged for general cleaning as general cleaning was required by law before the apartment could be rented again. In fact, back then the owner had to paint also as required by law. The RENTEE in NH has far more rights than the RENTOR...

Sorry, Biggity. Got a little off course...

yeah- we tried talking to him. He won't budge, so we'll take it as far as it needs to go.
The building was an apartment building so the zoning is probably ok. But good point on the tax records. we'll look into that as well.
