I was run off the highway by a 67 y/o veteran. He passed me in my lane got in front of me and locked em up. I tried to get around him but ended up laying it down and sliding a few hundred feet. Didn't hit him or any other cars. The friendly officer who showed up on scene (and didn't see any of it) gave me a ticket for failure to yield and following to close.

Unless the driver is saying you accident was his/ her fault, the answer is "no".
I crashed last year when a guy pulled out in front of me which caused me to take evasive action and I crashed. The law states any driver coming to an intersection that there is a light or stop sign must yield to ALL on coming traffic. Just because they dont see you doesnt make it okay. The guys insurance company tried to balk and i then proceeded to threaten to bring a lawyer in and they paid out.

Something similar happened to me... a tractor trailer squished me out of my lane.. I had a choice to let him run me over with a passenger in my cab, or bail over the median and total my truck with concrete and sign posts. (he never stopped) NORMALLY I'd have been at fault for not controlling my vehicle, but 3 eye-witnesses signed statements and the trucker was at fault....
Basically get a neutral third party to validate the incident
This happened to Rob in his car a few years ago, messed up his car pretty bad. He did hit the lady, and it would have been his fault had there not been 10 witnesses who stayed to turn her in for driving like a douchecanoe.
But, I'd say you're SOL without witnesses or an honest "victim".

I broad sided someone in my car a few years ago. They turned left in front of me. I could have swerved to miss them but would have gone off the road and smashed the car regardless. I decided to just hit them. That way I knew they would be paying for damages. It kind of amazes me looking back that I had that whole train of thought in a fraction of a second.
