I live in a cookie cutter neighborhood, we have a clause that says no chicken's rosters etc... but it's not enforced at all.
We have made several very polite phone calls to the owners explaining that there roster's - chickens keep coming into our yard and ripping up our flower beds and lawn looking for bugs I assume? They are also waking the baby up because the thing is on my front door step cocka dodo every morning for the past month.
It's my understanding speaking with a lawyer friend that in order for me to peruse this all monies will have to come out of my own pocket I would I have to sue them my self.
Before you say I would just shoot them, what is the law behind such action If they are on your property?
At this point we are sleep depreved the baby is getting little sleep the dog has chased them out into the street almost getting hit by a car. I'm really sick of this shit.

exactly my thoughts...altho I'm an animal lover and would hate to see a critter suffer because of their owner's stupidity. He should keep his rooster in a shed...doesn't he have a little house/shed/shelter to put them in?? My mother in law has a neighbor who has chickens and rooster, you don't see them outside at night or early morning.

If you shoot or poison it, you could be charged with felony animal cruelty if the town has a liberal PD.
Does the town have an animal control officer?

To make sure your ass is covered - a few days before spreading the 'fertilizer' put signs up in your yard, and call/email the neighbors. After all, wouldn't want the neighbors kids to get sick from the 'fertilizer' now would we...
Next - change the antifreeze in everything you own. Store the old stuff in open pans on the property line. Got to make plans to get that stuff to the recycling center...

Call animal control. Their job isn't just limited to wild dogs. If there is a clause in the homeowners associaton handbook or whatever banning livestock. They will come and take them away. As for your losses why not small claims court. Just have all the info like dates you spoke to them and that the landscaping was trashed etc.
buy some obnoxious animal yourself and let it run around their yard....when they complain agree to get rid of it if they get rid of (or take care of) the rooster

I have a rooster and the thing used to crow right outside my window. i woke up at 5 one morning and waited for his stupid ass, i gave him 3 chances. he crowed 1, 2, on the 3 time i hit him with about 4 bbs, didnt break skin, but let me tell you this thing NEVER crowed in front of my window at 5 in the morning EVER again.
also it was a really low CO2, i couldnt in good concience actually try to hurt the thing i just wanted to scare it away.
I also wouldnt suggest doing this to a neighbors rooster.
how big is their yard? could you ask them to move the chickens to the other side of the house, we have neighbors and they asked us the same thing, and thats what we did. and my neighbors like to call the cops. they were very respectful about the whole thing.
technically your covered under a nuisance law and you have to ways to approach it. One is to call authorities and have the roster taken off of the property, the other is more profitable and you can sue for not being able to enjoy your land. I take a couple law classes and we studied very similar cases.
Many of NH's small towns simply don't have an animal control officer. But as has been said, call the board of health. Also as has been said, look into a noise ordinance / nuisance law. They exist in most towns...

My personal vote would be some big speakers, some children of bodom, slipknot, meshuggah, basically any loud screamy metal and have at it. When they come to complain, tell them to shove their rooster up their ass.
Also Dougie - most towns in NH prohibit animals running around freely outside of the owner's property. This usually applies to both 'livestock' and household pets. It's their lawful duty to insure they're restrained to the confines of their own property...

asshole, that's what killed my dog when I was 6... and about 2 other neighborhood dogs. But since this is a rooster, I'll look the other way.

Yes - leaving pans of antifreeze out is an asshole thing to do, and in a normal situation I wouldn't even suggest it.
I also wouldn't suggest ejecting a neighbors dog from your front yard with a load of birdshot at the base of the tail as it squats to crap in your yard. But - growing up my father did it after the neighbors German Sheppard tried to attack me and my sister in our yard, and the neighbor's response was that we should go in the house when the dog comes in our yard...

Whatever happened to the whole protecting your property/privacy mentality? I thought you had the right to forcefully remove anyone or any animal that is on your property that does not leave with a reasonable request.
I personally would use a nice compound bow. No noise, and very deadly. Then you can discretely dispose of it. The neighbor will just think it ran away.
As far as legal action... Take them to small claims. You don't need a lawyer and you can sue for up to $2,000. The only legal fees is around $40 to file for the process. Its possible that just receiving the court notice alone will make them listen a bit better. They also have the option to settle out of court. At that point you could talk to them about reimbursing the court fee and the damage to your garden as they would have no chance of winning in a trespassing case (not to mention your community prohibits those things). BTW, get pictures of it on your property.
Good luck with that. Only "farmers" get lieniency in that regard. The rest of us are supposed to sit idly by while awaiting the po-po.
