both sides have valid points, I personally think its a bit of a stretch on Monster's part though. IF Monster has plans to come out with some kind of energy beer (ie tilt, sparks, etc) then I suppose that at least starts to justify their case. I still think its a stretch though.

Both the examples you cited Richie are products in the same category. The beverage industry is segregated into categories. Beer and energy drinks are not in the same category and it would be very very tough to convince a court that they are. Shoot the mere fact that the main demographic for Monster is under-21, excluding them from even buying Vermonster, is a pretty huge point.

I sure would like to see the documents between Monster.com (the resume service) and Hansen's back when Hansen's rebranded their shitty energy drink to Monster. Bet that was fun.

nope. although i did used to pick up a Hansen now and then back before the Monster brand. check out the 'Energade' product name, pretty funny.
