Does anybody have a true understanding of the legal issues here - I know what the protestors are arguing, but I came across an article from when the track first opened that says that there are no zoning laws in Harpersfield, but you do have to seek permission to "alter the land."
So there's no "zoning commission" and apparently the planning board can't deny your application because they don't like the intended use - so that suggests they can't tell someone that they can't use a track that they have - much less limit engine size and attendees...the land is already altered - so maybe they could tell them they have to return it to it's previous state - if they argued that you didn't abide by the usage stipulations that the planning board put into place (but the planning board isn't supposed to care about usage to begin with....)
So I'm confused on what leg the protestors have to stand on - unless the article is just off base...

I will add a comment that I think they did an exceptional job at managing the sound. I noticed when I was sitting in the pits that I could not hear the bikes AT ALL unless they were on the front straight, a mere 50' away from me. As soon as the bikes went around the first corner the sound almost vanished. A couple times I wondered if they'd thrown a red flag. Even the 'tards and ratty ass cafes. I noticed that they'd built up berms all along the front straight, undoubtedly where the noise will be the greatest. Couple that with the natural setting of being on top of a hill, higher than most of the land around them. I think the sound radiates up, not out to the houses around it.
I have a very prominent drag strip and two local 3/8 mile ovals within earshot of my home. Come Friday and Saturday nights I understand what motorsport noise is all about. But neither manage it as well as NYST does.
They violated the Open Meeting Law. Pretty much the jist of it. Everything else came after.

nhbubba, you were there on a very quiet day. What was there maybe 40 riders total? But I do agree, it is not that bad even on a full day. I wish I had been there to meet you, but I had to go and throw it away the day before.
Funny thing I overheard at the motel was some townsfolk talking about the noise when it originally opened, and how quiet it has been lately since they have started deactivating cylinders on the motorbikes.
Yes. Very quiet day. ~40 riders sounds right. Maybe my experience is abnormal.
But I was very impressed with the place.
Why dont they try and enforce a max DB level like MX tracks do? It couldn't hurt, and would at least show they are trying. That small town seems hyper focused on what the track does.
I wonder if the track could survive temporarily on 250cc clientele for a short period. Bet the track would be fun on a 250 2-stroke supermoto.
600 performance out of a 250. Hmmmmmmmm!!!!!!!!!!!!!
Maybe they are all for the smokers.
Lets see them complain about the CC size with these.

Who used to run a 250GP machine in the dash?
Not zoned, does not imply you can do anything you like with the land..
My understanding:
Quite simply... you must apply to the town planning board re: use of the land with enough detail so the town folk can understand intended use.
Initially the plan submitted was for small bikes in limited numbers.
Also the town did not vote - the planning board approved (against state law).
