New Pending Quincy Ordinance – Motorcycle Restrictions After Midnight – Feb 6, 2017 – quincy.com
BE IT ORDAINED by the City Council that the Quincy Municipal Code is hereby amended as follows:
In Title 10 Vehicle and Traffic, Section 8.0 Rules of the Road is hereby amended by adding the following new section:
10.08.400 Operations of Vehicles — Motorcycle Restrictions
A. Licensed motorcycle operators are not allowed to drive between midnight and 5 a.m. unless exempted from the restricted driving hours for employment or emergency situations.
B. Enforcement of said ordinance shall take place 30 days after public notification. C. Minimum penalty for first offense $250.00 repeat offenders $500.00 D. Law enforcement or rescue vehicles excluded.
That's absurd.
They should institute one of those "no excessive noise" and/or "no cruising" rules, if that's what they're trying to accomplish.
No one upholds the noise ordinances so now we go full retard knee jerk.

It's not happening, because it's illegal. It was apparently drawn up by a councilman and promptly withdrawn when he found it to be 100% illegal. For some reason the Quincy site decided to run it as a headline anyways.

This is easy, I'll bet the councilman was responding to constituent complaints. We're talking about a local councilman, and his proposal brought the issue to light.
Even without any ordinance, this may prompt a chat with the QPD about enforcement of existing laws.
The motorcyclists' right to ride is fine, when the noise conflicts with residents' right to peace and quiet in the middle of the night...
I lived there for a couple of years recently, the only "issue" I ever saw was a bunch of bikes parking on Quincy Shore Dr on the beach. Possibly lots of complaints from neighbors? Very strange though because Quincy goes to sleep around midnight. Maybe there was some malfeasance going on late night but I can't say for sure. Very odd bill to try and get through though....

I'm kinda curious what about it was illegal. Everyone likes to say driving is a 'privilege' when it comes to aspects that don't affect them. But if you claim it isn't a right, then how can a city not declare who drives on their roads? Is the primary issue that the roads were paid with federal or state money so the change would have to come from them?
The sad part is I wouldn't be surprised if the knee-jerk reaction from the skid-lid crowd was to be sure to go wide open on every street in Quincy at night. It probably would have been better if they threatened a crackdown on open pipes if people didn't keep the noise down between 12-5am. Which seems pretty reasonable for all.

So, the key thing that faulted this law wasn't a rights/privilege thing, it's the fact that you can't discriminate between cars and bikes when setting road access restrictions like that. If you want to ban ALL traffic after 5am, you're in the clear. Try to pick and choose, no go.

They install aftermarket exhausts on Harleys along with service. The owner lives in Quincy and told me he installed one for a customer, and the next morning at 6am heard "Vroom," and thought, "What have I done?"
