Looking for legal help, central MA / northern RI

As the title says. The Scituate RI police did NOT cite the girl who turned left on front of me and I just want to cover all the bases.

I do not feel like going this alone, because I know how ruthless insurance companies can be.

Familiarity with RI motor vehicle law is a must.

    PM me with info please.

The officer didn't say anything about a warning, written or verbal.

I think she's being a little nonchalant about it, since I'm up and about. I just want to be sure that everything gets paid, especially the trip to the e-room.

This woman pulls out in front of you causing an accident and putting you in the hospital and she dosen't even get a warning. BS. If someone on a bike dose a burnout at a light they'd have a ticket written before you could shut the bike down. This type of shit pisses me off. Glad you came out ok and listening to me vent.
Heal up quick and good luck

I went down to speak with the officer who took the statement today. I will wait until I receive the police report to stat questioning anything.

Police report means little to nothing regarding liability being determined by your insurance company, or hers.. Clearly she failed to yield to you- XXXXXXXXXXXX

I went back and deleted some specific suggestions about what to tell your insurance company or hers.... PM me if you want specific suggestions on what to say and what not to say. Some things on the other thread are counter-productive to you and if known by her insurance could financially impact your settlement amount. Stop posting about the details of your crash to the extent that you have so far layed out for it is best kept out of a public forum such as NESR.....

I am a auto claims manager for a major carrier in MA- PM me if you want or need help with your negotiations or settlement discussions. I deal with identical situations like this literally every day

Also, RI law has nothing to do with it since the accident happened in MA.

Doesn't left turn NEVER have the right of way? Why wouldn't she have been cited? That seems wrong.

Its the asshole doing 80 in the fast lane of the highway thats a danger to society and deserves a ticket, not the person failing to yield and sending someone to the hospital. Fucking bullshit.

Re: Looking for legal help, central MA / northern RI

the lack of citation doesn't really hurt your case. The lack of significant injury means that your claim will be modest. You should easily get replacement cost + a couple thousand dollars, though a lawyer will need to be involved to get there. Don't expect a payday, even with a good personal injury lawyer.

I just went through this with my wife and I both injured in a similar crash, but much worse.

Good luck, and don't stress too much. Get a lawyer and forget about it for 2 years or so.

This sounds a little misleading. He should get reimbursed for the bike and his gear immediately and the medical portion of the claim will drag out 2 years, no?

Oh, yes, that's correct. gear and bike now, medical later. New bike is tricky, cause it's worth less than you owe I would imagine. Pain and suffering will likely bridge the gap, but you'll be waiting 2 years for that.

I had the added problem of the insurance companies dragging their feet to pay my bills such that I was put in collections.

That's why I got the gap insurance when I bought the bike. It will bridge the gap between what the insurance pays and what I owe.
