    failing to stop for police

    I was speeding today and didn't realize the officer behind me was attempting to pull me over right away. I eventually heard the sirens, looked behind me, and pulled over immediately. The office is trying to get me for failing to stop, which is a criminal offense. He noted I was going 55 in a 30, which I'm not going to argue at the trial because honestly I was not paying attention to my speed and can't say whether I was or wasn't honestly. In addition he says the registry does not recognize that my bike has been inspected all though it was and has an inspection sticker to prove it, so he told me to get the paperwork from the dealership to prove it. All in all how do I convince the clerk magistrate I really had no intention to run? I hope the facts that I didn't speed up and did pull over as soon as i noticed will be enough, but this officer insists i had no intention to pull over and i only pulled over because i reached traffic. Which is completely false. I figure if i were trying to run traffic would have been my advantage to get away and i didn't try that as well as my speed. any advice?

    That happened to me last year. I didnt see him and I was flying. He threatened to get me for trying to run but just gave me a heafty ticket. I fought it and got it reduced.

    That sucks, its one thing if you get caught after trying to run, but if you didn't notice....

    You might consider calling the police officer and telling him exactly what you sid above. Considering you dont intend to fight the ticket, he might cut you some slack on the Attempting to Elude charge.

    I got pulled over weeks ago for speeding 85 in a 65 zone. As soon as I saw the cop on the side of the highway putting his lights on, I was thinking "he's either going after those guys in front of me, or he's coming to get me" so I proceeded to slow down IMMEDIATELY even before he could get his ass in traffic and come behind me. The asshole wrote on my ticket "slow to stop" and "little yapping dog" in the comment box. WTF??? I made a point to slow down and pull over in the slow lane immediately in case he would pick me and not the other two speeding cars, thinking he would give me a brake if he didn't have to even speed up to me, and he wrote that bullshit on my ticket.

    I wonder if you got the same cop as me? Was it on the masspike near Worcester by any chance?

    edit: because I can't read. Doing 55 in a 30 zone is certainly not on the masspike...

    this happened to me last winter, although i was in my cage (Jeep Rubicon)

    55mph road (route 9), snow storm, i'm in 4wheel but just cruising since it was late and no other cars on road.

    cop musta saw me go by, tried to high-tail it after me but couldnt get traction, i'm assuming, cause by the time he got to me way down rt 9 i realized his lights were for me. no clue 'cause there was a car broken down with hood up at the top of the next hill. wasnt sure if it was accident or whatever. i wasnt speeding.

    long story short, cop went BALLISTIC on me. told me he could haul me off to jail, i didnt pull over, blah, blah, blah. frisked me, yelling at me, etc.

    i was all yessir/nosir but all he would do was yell.

    ticket said 'speed greater than reason' and 'failed to stop'.

    i went to court twice for it. faught the speeding and won, thats the stupidest road to speed on, plus it was snowing like crazy. i was just motoring.

    the other stuff the magistrate was like, 'huh, i have no idea why the officer reacted like that or wrote you up for failing to stop' ... 'you can either pay the fine or show up for court again and fight it with him'

    i chose to fight again... copper never showed.

    soooo, i bet the magistrate will tell you something similar, that they weren't there and you will need to fight in court with officer present because its kinda serious. did you try ringing his station and either talking to the officer himself or his superior? i got out of a stupid CT ticket by calling everyone i could. different situation, but if you show your honestly trying to correct something it might pay off.

    Don't know about the rest of it, but as far as the sticker goes the inspection station stamps your registration with their # and puts the sticker on the bike.

    thanks for the advice guys. maybe i'll take a trip down to the station tomorrow although i spoke to him at the site and he refused to believe it. i was so paranoid on the bike this evening i keep looking behind not sure if i hear a siren or not now.

    I had this problem last week. I was speeding for sure but not at the rate he claimed. 60 in a 30. It was estimated speed not radar. However the actual speed limit was 35 where he got me at first and then dropped to 30 as you get close to the light. I didnt see him and I stopped at a red light and he pulled up behind me with his lights and siren going. Luckily he was a bit understanding since he was in an unmarked car and realized that it was hard to see his lights. After writing me a 200 dollar ticket he asked me about my driving record and then told me that I should appeal his ticket and he wouldnt put up a fight.

    I got pulled over Friday on my way home from work, right down town.. Seems he was looking for some guy on a yellow bike who flipped him off a few nights prior, after he had told the kid to stop Reving his engine up and down the street... I shot the Shit with him for about 10 minutes, really nice guy.. i guess it happend up by Fitchburg state college, so this is when i let him know "My wife does not let me go any where near the college for some reason .."

    You pulled over. Traffic, coulda, woulda, shoulda, blah, blah, blah.

    You pulled over: not after you wrecked, not after the LEO tackled you.....or was called in on the radio and boxed in by 4 cruisers......

    Even a Clerk Magistrate should see this one.

    If you don't fight the speeding charge, at least work them for 1/2 the fine. Its the "usual deal" to everyone* at a CM hearing.

    The courthouse is in Peabody, which is their home turf.

    The magistrate in Salem is a friggen LIAR!

    I had my run in with him..long story, but I took it upstairs (told him I was done with him!), and made the cop look like a total stupid fuck....couldn't even answer the questions I asked him. Gave the peeps waiting for their case to be called a really good show. I guess this cop wasn't very well liked if the court cop walks up to you and said "Good Job!" with a smile on his face.

    Don't bother talking to the cop
    just appeal it and go to court and the magistrate will probably drop the evading ticket and make the speeding one stick and then appeal that and take it to the judge and odds are you'll win.
    Remember it's your right as a citizen to appeal this crap all the way to the high courts if you want.
    My last court date I lost in the magistrates court and lost in the circuit court and I appealed it to the superior court and won.
    It cost me 350 bucks in filing fees and other bullshit but I beat it and have no loading on my insurance
    If more citizens knew their rights regarding traffic tickets and appealed it all the way the courts would be so clogged nothing would get done.
    Unfortunately most people have to work and can't take the time off and the system is skewed in favor of the law.

    I got pulled over for speeding last year, and the officer also gave me a ticket for no inspection sticker.

    The sticker was right there on my plate, where it should be. I told him that, pointed him to it and even showed him the valid date on it.

    His response was, "well the registry shows this bike has never been inspected, so I'm writing you up for that."

    As I prepared my defense I discovered that the registry only records inspections for CARS, nothing else. They do not keep any inspection records for motorcycles. The records are kept at the place of inspection until a govt "runner" picks them up, which happens about every other month. Then they get filed in some room at City Hall (picture Indiana Jones and the Raiders of the Lost Ark).

    When the cop looked my plate up in the RMV system it must have been missing inspection data - which is NORMAL for a bike. Hence he gave me the ticket.

    You should have no problem beating that charge on the ticket, as long as your inspection is indeed valid of course.

    Last friday nite 10:20 pm ,,,i got stopped in my 86 stang in Wareham. See lights blasting up behind me, think it was some kid that wants to race. I see its a cop, he follows me for 7/10 mile we stopped at 2 lights as well. Blues me, licsense reg, I have my window half way, smoking a butt . I ask why he stops me, the Manbitch starts yelling Don't you know its against the law, to not slow for a RR crossing!
    I say, I wasn't aware of that one But I slowed as I have a few K worth of suspension that I don't want to destroy. Makes me roll down the window under threat of arrest, and put butt out.
    Anyways, he berates and threatens me for a while, asks where I've been, I tell him I stopped for a large pepperoni pizza and 1 heinekin, ask him if he'd like to see my receipt? Tells me out of the car, does 4 sobreity test, which i pass all of them. I did say that 1 beer can make me fucking crazy, ask him if he understands what 1 fucking beer is???? So then he frisks me, and he GRABS my cock, and squeezes it too.
    I then think I'm trapped in a Outer Limits episode with a Fucking gay cop His name is homo police man Summers, just in case anyone drives through Wareham
