NH ticket question

    NH ticket question

    Just a quick question for the NH residents.

    i got a speeding ticket, 75 in a 65. $100 fine. I intend to just pay it.

    On the back of the form it has 3 boxes.

    1. not guilty
    2. guilty
    3. no contest

    I'm guessing no contest is best, no admission of guilt. Any advice on which box to check?

    No contest means you arent pleading guilty of innocent and are leaving it to the mercy of the court. They will however find you guilty and give you the same fine, but you admit nothing. I have plead No contest many times. The outcome has always been the same.

    fight it...if you at least show up they may reduce the fine. hell...if you tell them the story you might get off scott free

    Man, I just got a $250 ticket, 82 is a 65....big difference in the amount

    Make sure if you fight it expect to have half a day wasted. I've always paid and said guilty. I know I was in the wrong and after one time fighting a ticket I find it's not worth the time and effort unless it's a huge fine.

    I am guessing issued by a state trooper?.... If you fight it, they will assign you a date that the trooper is scheduled and I repeat scheduled in court. FYI.... I would no contest and pay as you stated

    Also, if you had NH plates you would not have been issued... so maybe fight it if you can

    He gave me a break. I was doing the 83 he said I was. Reduced it to $100 fine as I had license and reg ready and told him he got me fair and square.

    I don't intend to fight it. I have a spotless record for past 7 years (hard to believe I know).

    I'll go with no contest. thanks all.

    If you check the "no contest" box, the state will send it back to you because the amount of the ticket does not mandate a court apppearance, at which point you would be able to plead "no contest".....at least, that's how it was explained to me a few years back when I had a ticket returned to me.

    Things could be different now, however.

    With a good driving record...a NH magistrate can 'suspend' the ticket for one year. If during that time you do not get another, it becomes null and void, if you do, the ticket will be enforced.

    That is what happened to me when I got a whopper of a ticket in Geoffstown.

    NH doesn't have magistrates. The prosecutor can have the ticket 'placed on file' if you can convince him to. You need to make those arrangements with him on your own prior to the court session.

    I am from goffstown!! I got a ticket for having my visor up at night and they suspended the ticket for one year as Jaynus said as well. They tend to do that a lot with people with good records. I have had it done twice in NH.

    I never went into a courtroom when I went. I met with a guy who I thought was a magistrate....he did the agreement I put above after I gave my 'i have a good driving record' thing.....

    There was never a courtroom involved nor did I have to convince him....he offered it.

    I don't know where you were but I've fought a whole lot of NH tickets and I've never had a magistrate and always been in the courtroom at first show. Right on the back of the ticket when you select 'not guilty' it explains that you are requesting a trial and that's what you get a date in the mail for. If you were in a hick town the guy in the overalls in the farm house is comprable to a judge in a courtroom.

    Seeing this thread reminds me: I got a ticket from a statie in NH. 83 in a 65 which he knocked it down to 70 in a 65. Outta the goodness of his heart . . . or yea, cause I have bewbs. Anywho, I can't find the damn thing anywhere and I know it's been more than 30 days. How screwed am I?

    I found this but all it mentions about "no contest" is where to pay the fine same as guilty.

    Guilty or Not Guilty?

    Before paying your ticket you must decide how you will plead. It is most common for people to please guilty to speeding or other traffic violations. More complicated traffic tickets, like failure to use due care, may be contested.

    To contest your ticket you will plead not guilty. This plea entitles you to a court hearing where you can present your case and fight the ticket, fine, and potential DMV demerit points. A review of the Vehicle Codes will help you develop your defense.

    The DMV will contact you, usually within eight to 10 weeks after you've filed the not guilty plea. It is up to you to follow through―after all, it's your license on the line―so if you don't hear from them be sure to contact the court.

    If your case is more clear cut you might want to plead guilty or nolo contendre. Both pleas require you to pay the ticket fine and submit the paperwork on time.
    Paying the Fine

    If you are pleading guilty or nolo contendre then mail your payment and paperwork into the Bureau of Financial Responsibility:

    * Department of Safety

    * Division of Motor Vehicles

    * Bureau of Financial Responsibility

    * Plea by Mail

    * 23 Hazen Drive

    * Concord NH 03305

    Your clean record is all the more reason to fight it, I used to get off with a warning all of the time when I had a clean record. Now with my blemished record, theirs no warnings, just tickets.

    The strategy to take is not to let it get into a court room unless the trooper or officer fails to show up, and then you’ll need to ask for it to be dismissed. Just track down the guy in the court house before court and explain about your spotless record and chances are he’ll cut some deal, not a moving violation.

    i disagree, a 100 dollar ticket quickly turns into a 1000 dollar ticket when you factor in your insurance. just go to court. worst case senario you have not lost anything. best case they either drop it (pulled over 5 times in the past year, no conviction) or reduce it. it is a no lose situation.

    i do not know about NH but in mass the trooper is not required to show up in court. they just send one cop from the department to handle all the tickets.
