Re: Last ride of the season = blue lights!

The officer stated that he chased us down because when he caught up to the truck we weren't behind it, and therefor must have passed it on a corner. The officer said that the truck waived him past. What he didn't explain was how he managed to catch up to the truck. He must have been chasing us before he knew we had done anything wrong. Either that or the truck was going incredibly slow. Either one substantiates my arguments.

as someone who is in court on a regular basis as an expert witness, I can tell you, the diarrea is flowin off your keyboard

My father got ripped off. He sued the people that didn't want to pay him. One guy who worked closely with him wrote a letter for the judge and signed it, as he could not make it to court that day...my father did ask him to come testify. The defendants were accusing him of not completing the job and a bunch of BS. Said letter was read to the court. The defendants lawyer said throw it out it's not admissable as evidence. The just said "Oh yes it is".

So uh??? diahrea is flowing off of who's keyboard? That was at the court in Chelsea VT.

Also to add, the straight away needs to be 400+ feet in VT to pass on solid yellows. 5.0 didn't see you guys pass, if you take pics make damn sure that section is over 400 feet and tell the judge that.

As to the others saying to tell the judge you passed an unsafe vehicle hauling a lose load...devils advocate here ...why didn't you stop? why didn't you slow down? why didn't you amend your route? why not follow at a safe distance and wait for the truck to turn or pull over?

In the end, the copper and judge will look at it as, you didn't have to pass said truck. There were other actions you guys could have done to alleviate any immediate danger, etc.

The coppers were on 17 a lot last summer. I had seen marked and unmarked cars, last time I went over the road with Hellion850 we got tipped off in Bristol by some kind fellow on a yella 748. I knew were the copper was and behaved the whole way...get there and he's got many bikes pulled over and as we pass he's giving me the death to you look.

    How nice.

    Good luck with the ticket

Also tell the judge how twisty the road is with the blind turns. Passing on a corner on that road...pretty much signing your own death certificate.

We had our court date on December 30th. It went OK, but the judge didn't make a decision at that time, and would mail us the judgement. Got the mail on Saturday - she ruled in our favor! Yeah!

LED's and chrome rims. Maybe a disco ball hanging from the rear fender and some black lights below for that retro look. I'm going to pimp it out!

Or maybe I'll slow down on the street and put my money toward track days...

Was the cop there, and what did he say?

Sorta weird that she wouldn't rule from the bench, any obvious reasons for her delay?

Re: Last ride of the season = blue lights!

We (myself and the other rider) arrived early and met with the officer. He took us into a little conference room and asked why we were contesting the ticket. Long story short, he ended up kicking us out of the room for being confrontational. God's honest truth we were not being intentionally confrontational. I did disagree with him when he said that there wasn't a safe place to pass on the road. I said that the truck was moving slowly and I tried to show him a map. He got very upset and made us leave. It was really really wierd.

In the court he was very fair and presented a good case. I think we did the same. I think the deciding fact was when we presented a Google Earth image that showed the area. The straight that we passed on was clearly well over 900' long based on the scale shown on the map. He tried to get the map thrown out as evidence because he hadn't seen it before that day. The judge corrected him, that is only applicable in criminal court, not traffic court. He then contested the accuracy of the map - the images were taken at least 8 years prior. At that point the judge decided that she was going to have to think more about the case.

It seemed really wierd that she didn't make the decision right there. I haven't been to enough traffic courts to know if that is common or not. All in all it's not an experience I feel the need to repeat any time soon.

It's great you did the prep work and brought the map. I'm just puzzled over the obvious lack of evidence. He's already admitted he didn't see you pass the truck - otherwise, the map would be useless - so how could he cite you?

He wasn't there, the truck driver could have pulled over and waved you on.

    Simply amazing.
