I've done it. I financed through my bank so they handled most of it. But basically, my bank bought the title for the balance and his bank just sent my bank the title.
I'm sure its similarly done without a bank

If you're using a bank, what Oxx did works. If not, get a certified payoff check made out directly to the leinholder, and pay the balance to the owner however you'd like. Don't pay the guy and count on him making the payoff..it'd be nice to think everyone in the world is honest, but it's not the case.

I would imagine. The loanee doesn't legally possess the bike thus cannot legally sell it.

Had a buddy just hit me up for a similar deal. His girl owes money on a zx6 but she's claimed bankruptcy and has no intention of paying the bank. She already bought a new bike under her moms name. Wanted to sell it to me dirt cheap as a track bike. I don't need that headache. Pass.
