ticket.. help!

need to help someone get out of $50 ticket for running YELLOW light. wouldn't mind paying but what to say or plead to not have it go to the record.

any suggestion VincF2?

Go in and fight it. Some friends of mine got a Lowell cop on desk duty for a few months because he harrassed every sport bike out there. It was in the paper and everything.

Actually... Although not used often there is a CMR that sites yellow light violations... 720CMR9.06(10)(c), (h) or (f).... depending on the exact violation...


Kham... obviously I dunno the circumstances... so it's hard to say what's what... but definitely fight it... I can guarantee you that the cop doesn't care at this point if you get out of it or not... he did his thing... ya know...

he sited for red, but we argued yellow. he pulled 2 cars, us and this other dude. we got $50 while other guy got $100. this particular cop is a dick. it was YELLOW YELLOW YELLOW.

Appeal, request a trial.
Subpoena / or ask for public record information for your citation, (for the exact chapter of the violation) and the ticket number of the party pulled over with you. (its one number up or down from your citation) You also want the officer's notes on the back.
Kinda hard to reason $100 fine for one and $50 for you if you did run a red light...........................why's theirs higher?
Remember, you both supposedly did the SAME thing...........

Ya sounds fishy...Fight it you should prolly come out OK.

If it was yellow when you were in the intersection, it should not be a red light violation. Most states have laws that say: if a person is in the intersection when the light turns red, it is still that drivers intersection and they can go in any legal direction their lane position allows, without penalty. Check what your states laws are on the subject. As long as you can honestly say that the light was still yellow when you were fully in the intersection the ticket should be dropped (or at least reduced...his word against yours).

I would say that I proceeded through the yellow light because it was unsafe to stop for fear of being rear ended by the car behind you.

Which it clearly was, because he proceeded through the light as well.

By the way, I had the same thing happen to me a few weeks ago. Got pulled for going through a yellow light. Cop said it was red. I said, 'No, actually it WAS yellow!'. He "Let me go this time" with a written warning. I was mad he felt he needed to waste 15 minutes of my time for a yellow light.

Put a stop on the check, and call the town clerk and tell them you want to fight it.
