As many of you know, I was involved in a motorcycle exident last november. I treated after the exident and got a lawyer. Unfortunatley I found out that I had bursitis in my knee and that it would never really be 100% again.
I play hockey so every time I bang my knee I get fluid in it and it takes days for the swelling to go down.
Last friday the insurance company finally offered me a settlement and my lawyer called me and said that its probobly their best offer.
Since its a SOFT TISSUE injury and I only had about $2,000 in medical bills they offered me 6,500.
WTF, 6500?
I'm basically fucked for the rest of my life and thats all they are giving me?
Do you think this sounds right?
Any advice on what I should do?
So Do I take the 6500 which is really 4150 or whatever cause I need to pay the lawyer?
How will that effect me? If I sign off on that paper that meens that I can never go back to them and ask them for jack. Will my regular insurance pay for my doctors visits than or will they say that they are not responcible for something that was caused by an auto injury?
I'm in dire need of some good advice here.

That certainly sounds low. What does your lawyer have to say? Often insurance companies throw a lowball figure out there to see if you'll bite. They don't like to go to court, so tell them you want X dollars and see what happens.
That's a really good question about MD visits. Do you think this will need ongoing treatment? Your health insurance probably won't want to pay if it is related to the accident.

Well that is something you absolutely need to ask your lawyer before settling. For all the money those guys get you for, they should be available to answer all of your questions.

But doesn't your LOWER BACK still hurt? I thought you had mentioned that your LOWER BACK was injured?

My lower back is fine. It only hurt for a few weeks and I never had to treat for it.
It's my knee that ended up being more problematic. I thought it was just badly bruised, and it turned out to be bursitis, which is a permanent injury.

I'm finally finishing with my lawyer and insurance for my accident last year. Once you sign, you can NEVER go back. Whatever health insurance you have will take care of it at the time. I will probably have my knee rebuilt when I'm 50ish and health ins will cover it then, not part of the settlement. Talk with your lawyer about this. That does sound awfull low, ESPEICALLY if the accident wasn't your fault.Originally posted by Borislav

Sound very low for getting a perminent injury. Might want to go over it agoin with the insurance company to make sure they understand the nature of your injury. Soft tissue damage usually refers to only cuts and bruises.

I gotta agree with beet, tell them to stick that offer where the sun doesn't shine and tell them you will drag their sorry asses into court. Have your attorney tell them what you want to settle or you will see them in court. But once you lay these cards on the table most insurance companies will clam up and you have to sue to get justice. Get the medical stuff taken care of, cause you don't want to be fucked up for life, then take care of business. Not sure what the time frame is in the state where the accident occured, but most courts will make the insurance company (if you win) payoff your medical bills, some $ for pain and suffering, replacement bike and then some, usually more than enough to pay your attorney. But hey your attorney should be telling you this, that's what you are paying him for.
