I was on my way home through Hampton, NH and the traffic was something fierce. So bad in fact that my SV started overheating. So I started slowly splitting and I got popped by a motorcycle cop. Charged with RSA 265:20, "unlawful passing on left". I have a clean record, and I'd simply pay the $72 but I don't want the points.
Any recommendations? I have 30 days to answer the charges.
thanks,

never hurts to fight it and you get an excuse to take time off from work!

Screw that...take this one right to the NH Supreme Court. We ought to challenge this and bet land splitting legalized like in Cal. I'll contribute $10.00 to your legal fund....
(edit: YOU ought to challenge this....
not sure where I came up with that WE business Kimosabe)

My brother was heading home to Philly with his son and daughter-in-law Sunday after taking in the Sox on Saturday night, and got pulled over in CT for 85 mph in a 65.
"Where you going so fast?"
"No where, sir. Just have a long ride ahead of us. We were in Boston for a Sox game."
Cop looks in the back seat and says, "Sox fans, huh? Go on, but slow it down."
Cop + Sox fan = no ticket.
Cop + Yankees fan = full body cavity search
I feel for you but you're probably going to lose and overheating is no excuse.. if your car was overheating you wouldn't have gotten away with driving across someone's lawn or in the median or something.. the solution is to pull over and try to get the vehicle to cool down or wait for traffic to let up.
I will admit I've pulled over a few times in horrid traffic and chilled at a rest area, etc..
(And other times I've lane split)
atek3- Plead "not guilty" and offer to make a donation on behalf of the Hampton PD to the charity of their choice.
Hampton cops can be assinine someti...no, make that all the time.
There was a time my sister and I were cruising the Blvd on the bikes, she missed 2nd gear and mistakenly revved it....guess what. The boys came out of the wood work and pulled both of us over....ATV cop, bike cop, car cop.....I counted 5 of them.
No tickets but WTF? Get a life Hampton.![]()
Appeal the ticket. Never hurts.
I guess you might be on 1A. That road though beautiful the traffic is bad...and people drive like bitches!

STOP BREAKING THE LAW ASSHOLE!:
ok seriously, fight it. Like someone else said, I doubt the overheat arguement will do squat, but its worth chancing the cop won't show.![]()
Supa Motarded! If you see me backin it in, keep watching...Im about to crash

What about getting a lawyer? Worth it?

For a 72 dollar ticket? Are you fucking high?
EDIT: It's 3 points.
Just be sure that ticket is worth your time. My wife fought a ticket and we spent nearly 5 hours at the courthouse waiting to be called. After all that waiting on one of the breaks the cop that pulled her over said she's free to go and not to worry about the ticket. Over all we would have been better off paying the ticket and keep the working hours. Good luck.
Not to be rude here, but pay the fucking ticket and get on with your life. You were blatiently disobeying the law. We have all done this. Sometimes we get caught. Usually we know when we choose to do so that there may be consequences. Pay it and deal with it, 72 bucks and 3pts, whoopdiefuckingdoo. The overheating issue is a bullshit excuse, I wouldn't waste my time even trying it.
I hope that if you do take it to court they add some kind of idiot assessment, not only for fighting the ticket, but for lane splitting at hampton beach. Should've known better...
ill agree that lane splitting at hampton is asking for a ticket, but if you have a good record and dont mind spending the time in court its worth fighting it. If overheating is a bad excuse then come up with a good BS excuse

Who the fuck is this guy?
Go to court. Be nice. Tell them about your overheating and your previously clean record. If you have the time and inclinication there is no harm and no foul in pleading your case. THATS WHY WE HAVE COURTS...ITS YOUR RIGHT TO GO BEFORE A JUDGE AND ASK FOR HIS CONSIDERATION...
You weren't being an asshole or a squid...you were simply protecting your motorcycle and doing something that is perfectly legal elsewhere. (Never mind all the other pro lane splitting arguements...)

With no tickets on your record you might be able to spin the overheat angle. Was there a Gas Station up ahed? A DD, Any thing you can use to say I just wanted to get to "Xxxxx", grab a gatorade/iced coffee blah blah blah and let the bike rest.
