I am not saying that he should go unpunished. I am just amazed how all these people can sit in judgment like they are absolutely perfect. That is one of the problems today, especially in the motorcycle industry, you don’t have to do anything good, all you have to do is make someone/something else look bad.
Also from what I have seen Fania was standing up when he was kicked, not still down. So if you want to use something as an example Derek could you at least have the courtesy to make sure the details are correct?
The differences between the verbal and physical are obvious. But it also goes to Yates state of mind. Put yourself in Yates’ shoes. You are running second in the first race of the year. You need to score points for the championship. You need a good position because real racing is a results oriented business and contract negotiations/salaries/bonuses are all based on results. Now you have just been taken out by some guy that is four laps down (remember no matter what your own views are on this you are looking at this as if you were Aaron Yates). Now you get up and you are PISSED off. And the guy that took you out if telling you to f’off, saying you took him out. Now while that does not mean Fania deserved it, but you don’t think that those things contributed to Yates’ state of mind?
You don’t need to have kicked or headbutted someone either. There isn’t one thing that you have done in your life that you are not proud of and regret?
And just because someone qualified doesn’t mean they should be there. Just because they met the rule requirements doesn’t mean they have a clue as to what is going on. I do think the rulebook needs to be changed. While it would be boring to see a race with only 6 or 7 bikes out there, it also sucks to see the privateer time bomb go off and ruin the results.
I was talking to a friend of mind the other day that used to club race at Loudon. He has done two AMA nationals at Loudon. He said that it was scary. No one tells you anything about what is going on or what to expect. You just pay your money and you go out there in the deep end with the sharks, because those guys aren’t out there to play they are out for blood.
The Al-Qaida incident was just an example of how insignificant the Yates incident is in the scope of things. Just like OJ. It was not meant as any type of public discussion. There are plenty of things that go on in this forum that have no relation to racing that seem to stay in here also.

Just curious. Would it have been a big deal if immediately after the crash Fania has sustained tiny fractures in his spine only to have the injury aggrivated to the point of paralysis via Yate's head-butt? I think this point has merit based on what happened to Dajiro Kato. I read that he might have survived if he wasn't handled so roughly immediatley following his crash.

I think people are making a little more out of this than it deserves. Honestly when I saw both riders get up...I first was relieved, then I laughed at their childish behavior. Yates with his tantrum...Fania with his "eat this" gestures. I thought it was great entertainment...simply because the race was so boring. It sounds as if it got maybe more heated in the pits. Having raced both motorcycles and bicycles, I can tell you it's 100 times worse in bicycle racing! Imagine 80 guys in a pack all yelling obscenities at each other at speed, inches apart in lycra...I've even seen guys fighting on their bikes! Yates' behavior was amateurish...Fania's was just as childish and probably more offensive. Fania filing charges is not good for the sport at all, and a lawsuit sets a damaging precedent.
Prompt action by the AMA could prevent this type of occurrence...but we know that story. Moreover, the Daytona 200 needs to be overhauled. I don't know which race was worse, the Australian F1 race or Daytona. 4-5 guys racing for the win, with everybody else getting lapped is bad TV, bad racing, and bad for the sport. Fania and Yates' Three Stooges impersonation was the best thing I saw in racing all weekend. "Hey Mo, eat this!"
