Perhaps, I just want to know what really happened whether I win or lose. That's a really fine line the difference between a defect and production variation, and may be a moot point in a legal analysis.
For example, let's assume arguendo that only 25 bad cranks existed. Well I am aware of about a dozen cases just in my own research. So assume there are a few more than that which haven't made it to the internet, you know some blokes just don't DO internet. Well then you have a situation where the consumer has been sold a product that is "defective" and damn near certain to break regardless of whatcha'macallit. Like I say, I just want to know what really happened.... yes bikes have their certain quirks and some of them are readily understandable, like the Intercepter valvetrain problems. OR VW had some bad oil seals in the 70's in the first Golfs. We can understand that.
But cranks in modern vehicles really shouldn't be snapping.
