NY Ticket?

My 21yo daughter got a ticket in a small town in NY for “Unsafe Lane Change.” Looks like that is 3 points under their system. She’s never had a ticket before. She will be back in CO so no way to fight in person.

It was in my car and insurance is high in Boston. Not sure if this would hit me with a surcharge?

You have to plead Guilty or Not Guilty by mail. If you plead guilty they assign a fine and a surcharge. Looks like about $300.

Does NY follow through with reporting?

Would hiring a traffic attorney get it taken out of the Moving Violation category? Usually fight everything but this is a new situation.

Hiring an attorney usually gets it reduced to a parking violation in NY. She should get no points, not that it matters to her in CO.

Unsure about the insurance but I assume if you get it reduced nothing happens there.

This is true in MA

Even if MA and NY do not currently report to each other ( I believe this is done through a somewhat national database now that some states report to and some states check ) if/when they do in the future the ticket could come back to affect the premium on policies your daughter is listed on down the road.

That being said the first ticket against your license on the SDIP rating used in MA doesn't really surcharge you per se' but it does take away a step of credit that the insurance companies will give. Go from and SDIP rating of 99 to a 98 which does wind up costing more for the total insurance bill due to removing that credit step.

Looks like it is a function of cost vs. reward. How much will it cost to retain an attorney to get this taken off the driving history (and can that attorney guarantee that it will come off the driving history for the investment in their services) vs. how much will it actually add to any premium paid on policies your daughter is listed on.

I picked one. 38 five star reviews and is nearby. $300 plus whatever "0 point" violation it gets transformed to. Sent the guy an email inquiry and he called me five minutes later.

Update is Not Guilty plea is in and court date 2/22/22(!). They asked my daughter for her driving record (which is good) which MA charges $8 for.

What do they usually plead these down to? I’m assuming some non-moving violation with a $150-300 fine.

300 for the fine? The surcharge will be 6% of your premium per point for ten years (18% equals paying almost 2 years of extra insurance spread out over ten years) plus loss of good driver credit. Very expensive. It's a moving violation so it is a surcharge offense. The insurance board set these rates. A in-law is on the board. The board is 100 % democrat appointees. Good luck.

Garandman, they'll reduce it to nothing that matters (dealers choice) and she'll pay 100-200 dollars to the court and move on with her life with no points. A lawyer can appear for her. I have been to traffic court twice and I don't think I've ever seen anyone not get a reduction to a non moving violation.

You win the battle but lose the war if it the judge finds this as a moving violation. The officer that pulled her over is also forced to attend on that date. No excuses. If the department puts anyone else there, like a buddy reading off the officer's notes, you and your lawyer get the win by forcing a cross-examination, as is your right. No witness=not guilty.

I had a NY speeding ticket fine for $800 and 8 points. Paid lawyer $400, he delayed it 2 years. Never went to court my self. Ultimately, fine was reduced to $400 and 2 points. Never showed up on my MA license or insurance.

Yes I know that’s how it’s supposed to work, but I got pulled over again recently and the cop said, clean record: warning only and let me go. I was surprised it didn’t show up either

So the hearing was on 2/22/22 and as expected reduced to a parking violation with a $175 fine. Well worth it to keep her record clean, IMO.
