Someone hit my car on Sept 7th when I was going straight through an intersection. I had the right of way in the intersection for multiple reasons so I'm positive the other driver is going to be found liable.
My question is my insurance company and the other driverç—´ insurance company can't get in touch with the guy. My co worker was telling me that if "x" amount of time passes and the other driver still hasn't communicated with the insurance companies, he will automatically become liable.
Does anyone know what the "x" amount of time is?
it depends on the circumstanes, and whether or not the police are involved.
I had the misfortune of being a witness for an accident where some lady rearended another driver and took off, ........well being the good smaratan that I am, I chased down the car, and got the plate number, then circled back and gave it to the victim with my contact information.
The driver that hit her, said she was not driving, and it took 2 months for the claim to be reviewed.
It ended up 3 months later, the insurance company settled with the at fault driver admitting no fault. They told me after that if I had seen the driver and was able to identify her then she would have been prosecuted for felony hit and run...........needless to say the next time I will make sure to visually identify the driver.
That being said the claim can take a couple weeks just on investigation, and paperwork...... I have seen claims paid out in 24 hours as well.
