I had a wheel come off a boat trailer once....all of a sudden the trailer wheel/tire was passing the tow vehicle!!What a strange day that was.
Glad to here he is ok.

Yeah...thats why we HAVE insurance....They want your business and it's their job to provide you service. And they should be a lot better at getting you what you want. Having said that, I believe you should hold they're feet to the fire to cover your gear. Unless they can show you some freekin' exclusion in the contract...

Go after him personally or go through his home owner's insurance if that's at all possible. Had a dog run in front of my bike years ago, flipped my R6, dog owner's home owner's insurance covered the $7000 bill, gear, bike, etc...
Purpose of insurance is to come out after the accident like you were before, so anything with a scratch on it, I'd be aiming to get paid for.. Remember though once you sign off on the insurance check for the bike it's final, so look into this hard before you sign off on it..

He's retained a lawyer....nothing is signed yet.
Huh??? Why??? Did the other party not have insurance? Even so, his insurance should cover this with no problems. (Assuming he bought collision, etc.) Worst case should be he gets paid by his insurance and they hold back his deductable until they collect from the other party's insurance...? Or is he going for a 'big' hit? Getting a lawyer to collect for above and beyond actual damages...? ie blood money????

He, as well as the few lawyers he has talked to, believe there is negligence involved. I mean common, lug nuts fall off a wheel, wheel flies off and hits a motorcycle with 100mph of impact and totals the bike. That's something that shouldn't happen.
When it's all said and done as it stands now (IE No lawyer, no court, just letting insurance do its thing) He'd be done riding bikes for a few years. He owes $2k on the loan, so after the insurance pay out he'd be left with about 4 grand. that gonna buy a new GSX-R 1000? That even gonna replace the totaled one with a used one of the same mileage and stuff? No f'n way.
Not to mention the gear alone cost half of what he'd have left over.
I dunno. I'd be pretty pissy to if something like that happened and I couldn't go get a new bike to replace the old one.
His lawyer told him straight up, "you will not retire after this settlement" which he is OK with.
