When Tom Kekoni showed up for work at Babbitt's Sports Center (http://www.babbittssportscenter.com) on May 17, he had no idea it would be his last day.
That morning, a sales manager approached Kekoni, a 46-year-old certified mechanic, and asked him whether he had made a certain recent purchase.
The mechanic acknowledged he had, and the sales manager informed him that he didn't need to punch in for work.
Kekoni thought the guy was teasing him.
"Too late, I already did," Kekoni responded.
A little later, the sales manager again approached Kekoni, asking if he believed him.
Kekoni said he did, but he wanted to "hear it from the horse's mouth," referring to his boss, Eddie Babbitt.
Babbitt then fired Kekoni.
The reason?
Kekoni had just bought a 2005 Harley-Davidson Superglide motorcycle. Babbitt's sells products that compete with Harley, such as Yamaha and Polaris.
"How would it look if my mechanic drives in on a competitor's product?" Babbitt said.
Both Kekoni and Babbitt admit to the firing, which broke no laws.
According to Jack Finn, an administrator with the Michigan Department of Labor and Economic Growth, Babbitt did nothing illegal.
"Michigan employment is termed 'at will', and as a result an employer can terminate an employee without cause," Finn said.
Kekoni and Babbitt sharply disagree over whether a policy existed against owning competitors' products.
Kekoni, 47, alleges no such thing existed. "There was no policy," he said.
Babbitt, meanwhile, claims the policy always has existed. "It's been a standing policy here forever," he said.
Babbitt added that Kekoni should have been tipped off to the policy by two incidents prior to his firing.
The first was a firing about a month before Kekoni's. Babbitt terminated another employee for buying a Honda off-road motorcycle from a different vendor.
Before that, Kekoni said he approached a sales manager concerning some used Harley bikes in Babbitt's showroom. After Kekoni inquired about purchasing them, he said the sales manager told him, "You don't want to do that."
Kekoni said it wasn't clear to him why the sales manager responded the way he did.
He would later end up buying the bike through Sandy's Harley-Davidson in Fremont, and it already had been shipped when the other employee was fired.
Shortly after letting Kekoni go, Babbitt said his business came under fire from Harley sympathizers and owners.
"I've been blasted online ... it's not easy being the boss," he said.
Kekoni said he learned nothing can be done legally. He remains upset about the reasoning behind his firing.
"Everybody in my opinion has the right to own and buy what they feel they want to have," he said. "It shouldn't be dictated to you by your boss."
Kekoni said he plans to keep the bike.
"It's a helluva thing to get fired over."

well think about it. you own a dealership that sells polaris witch owns victory the other american bike maker. than your wrench comes wheeling in on its main rival a harly. i'd be pissed to. harly dealers have made millions in the last ten years most import dealers have not even come close. myself i would have told him you want to work here leave the harly at home.

I figure the manager was within his rights, as said it's an at-will state don't like their policies work elsewhere.
OTOH, you can't buy that kind of bad publicity. Betcha sales drop 10-25% this quarter for some unknown reason...
This is an old story. Can't feel too bad for the guy. He knew the policy ahead of time IIRC and went out and did it anyway just to get in a fight with his manager. That is an awful big purchase just to make a point.
The whole thing is just silly as it is not like he couldn't have gotten the same riding experience from a Yamaha or Polaris cruiser. They are so damn close to the Harley the only difference is the badge on the tank and being part of the club. If the guy had gone out and bought something like a Jesse James chopper that Yamaha and Polaris cannot duplicate his manager might have been much more understanding.
If the dealer is offering profit sharing to it's employees this guy is even more of an idiot since buying the H-D and showing it off to the customers hurts his own bottom line.
I have to agree with black vfr leave the HD at home, other then that its still a dick move......as an owner you give your employees the opportunity to buy the product you sell at a discount, but its there decision to buy or not....if not dont bring it to work....this shit kills me![]()

I can see the manager's point to an extent....when working in sales you have to support and be enthusiastic about your product at all times - everyone is a potential customer. But, on the other hand, no one can control what you personally like or dislike. Thus, if a competitor's product is appealing to you, you should not be banned from buying it. But, don't bring it where your enthusiasm for your product is at its most expected.
For example (on a much lesser scale), I work for Pacific Sunwear. Every person I meet is a potential customer, either for him/herself or for their children. I am expected to arrive at work in our clothing, not that of our competitors. I am expected, when I am not working, to show respect for our clothes and products, and show support for our product lines. However, on my day off, no one is going to stop me from wearing head to toe Aeropostale, American Eagle, or Abercrombie (our two main competitors). Like I said, a lesser scale, but the same idea. No one can expect you to ONLY buy products from where you work ALL the time, and you can't like anything from ANYWHERE else. Seems a little ridiculous.

Seriously though, I can see the manager's point. Polaris's Victory line is a direct competitor to Harley, and is making a good run at it with a decently engineered product. Harley still has the strong branding though, so having Harleys in the parking lot is bad for business.
