The new tactic is that the police run a MOTORCYCLE ONLY roadblock. They inspect the bike, helmet and especially the pipes. See below, sorry for the length. This noise issue will just keep getting bigger.

Information was just brought to my attention that a number of riders were stopped by the Stirling, Massachusetts Police on July 15th in a "MOTORCYCLE ONLY" roadblock at Routes 62 and 140 while on their way to a bike event. The police conducted inspections on all of the bikes that encountered this roadblock and issued citations to for "altered exhaust(s)" and non (DOT) compliant helmets. One of the riders asked the RMV officer on the scene about using a noise meter and was told that one was not needed. Later, while at the bike event, they found out that other bikers had received similar citations.
It is my position that roadblocks like this are discriminatory and unconstitutional. They breakdown any relationships between bikers and law enforcement. The resulting citations issued in these dragnets pose additional financial hardships for the hard working people who receive them and the principled who choose to fight them, by taking valuable time from work to prepare and attend the court hearings to fight for their rights.
Massachusetts law does not require a DOT approved helmet. Massachusetts Helmet Law M.G.L. Chapter 90 Section 7 states in part, "Every person operating a motorcycle or riding as a passenger on a motorcycle or in a sidecar attached to a motorcycle shall wear protective head gear conforming with such minimum standards of construction and performance as the registrar may prescribe....." The Massachusetts Motorcycle Association (MMA) states, "while a “DOT Sticker” does raise the presumption of “good faith” relative to testing, Federal Standards do not mandate application of a DOT Sticker on the helmet, and the lack of a DOT sticker on the helmet is not an indication of lack of compliance, nor one that is illegal".
Relative to the "altered exhaust" component of these citations, the cited offense is not the noise level of the bike, but the allegation that the exhaust was "altered" as to not be in compliance with the law or the pipes were illegal. Altered in what way? Changing pipes from OEM to another brand is not illegal. There is no RMV requirement for an OEM label on motorcycle exhausts. A first look at this tells me that this law is overly broad and very subjective. It should not survive any legal challenge. The City of Boston recently swiftly and quietly pushed through a motorcycle only law which went into effect June 21 and levies a $300 fine on riders whose exhaust pipes lack the Environmental Protection Agency’s seal of approval. This is another example of targeting bikers and in a discriminatory manner. The MMA is actively fighting this law in Court. See: http://tiny.cc/8wa70
The noise and helmet issues are important and we intend on looking into them in great detail and becoming involved in preventing the targeting of motorcycles by law enforcement. Please contact me if you receive a ticket for altered exhausts, loud pipes or non conforming helmets in Massachusetts or any State. I can give you information on defending yourself if you choose to fight any citations.

time to start REALLY crankin up 127.... how about we fix a REAL problem and remove huge SUV's and cell phones from the streets of MA..... If they are just looking for $$$$$ then they could make huge cash from that.... F'em and yes... my bike is loud but I can sneak into my apt. complex really easily... just dont rev the living shat out of your motor in traffic and you wont be noticed....

granted I don't see myself riding on 127 anytime soon, is it unusual that I'm trying to find a way to make my dirt bike quieter?
My exhaust is stock but still damm loud and from what I can see, no EPA stamp anywhere on it. It does have a large Husky "H" logo on it clear as day to verify it's stock.
First my insurance rates go up 50% for moving to Salem and now I run the chance of getting a noise, and other violations as my bike will not pass inspection due to missing parts and stuff.. oh boy!!

I have an aftermarket can on mine...these guys are on HDs, and thier laws (harrassments) may be different...should we make the ride late that night...all blacked out...pillows over the exhaust? Maybe you could lead the ride on that stretch...you can do all the 'splainin'...![]()
My Auntie lives on John Anderson Drive in Ormond, a 1/4 mile out of Daytona Beach down along the Halifax River. I know these roadblocks and whatnot are unconstitutional (hell, in a strict Constitutional sense, so are drunk-driving roadblocks), but when full-bore Harleys are run on a piece of straight pipe with no muffler and pull up alongside, MY mirrors rattle, let alone theirs. Then when they do the full-power takeoff, they GOTTA be turning 115 DB when they're running in pairs. I think that's the objection most peeps have about noise. It's not the sound I prefer, especially when they're up and down the road all night 20 feet from the house. Mostly, down there, that shit's bike week. They like to say noise is life, but I dunno. Peeps get startled, too.
