I'd ride with iPod sometimes on the street (and track) and I found the earbuds would move too much due to the helmet being buffered by the wind. 30 minutes in the earbud was jammed sideways in my ear canal and all I was getting was Major Pain.
So then I rigged it so the earbud wasn't 'in' my ear but more like nestled in the helmets ear cavity. Thus I'd still 'hear' the music but without it smashing into my brain. However at higher speeds the wind noise was so much that it'd basically drown out the music anyway.
Have decided it wasn't really worth the hassle at that point.
Note however that I still could hear bikes, cars, pavement, kneepucks, etc all around me. Even with music cranked up.
Now I just listen to iPod while riding Motocross. That's fun.

I use noice reducing headphones, it keeps the wind noise and exhaust noise out, allows you to hear the music, but also allows you to hear sudden noise changes like sirens or other cars, I love em. Keeping them in my ears putting on my helmets a pain, but worth it for long trips
I listen to my ipod a lot while riding on slab, but it can be really distracting. Sometimes I end up just turning it off. I can understand why there would be regulations against it.

Yah, these are a pain to keep in your ear when putting your helmet on, course I had big stick out ears, so that dont help, but Ive figred out how to kinda reach into my helmet and get them seated properly. Pain in the ass for a trip to the corner store, but nice for longer trips.
It's illegal only if you get caught....so, no, not illegal.
What about just ear plugs? would they be illegal?

I bought a pair of the HS68 spekers for my ski helmet. It doesn't feel quite the best since it is velcroed(sp?) right to the ear flaps but I think it would be fine under the padding on a MC helmet. The sound is pretty good and the volume can go up pretty high. I like the in-line volume adjustment too. You can turn it down at a stop light for example. I think I might get another pair for my MC helmet.
