You need to make sure that Commerce is not 50/50 ing this claim. It sounds like you might be being found at least partially at fault. Check on that. Tell them you accept 0% responsibility for this accident and you will take it as far as you need to to prove it. Then tell them they WILL be covering ALL losses, medical bills and pain and suffering. DO NOT cash any check until you are happy it is the final settlement. They are trying to avoid paying out for some reason and I bet that the accident is not considered 100% the other driver's fault....yet.
If you are forced to hire a lwayer, they will have to pay that bill also.
yeap - they're gonna waffle unless you hold their feet to the fire. it sucks, but it's how they play the game. If you're going after pain and suffereing def get a lawyer involved sooner rather than later. Bringing legal counsel to the table tends to change their tone.

the more you pester them the better your chances of getting whats fair.
I totalled my Erion Edition 929 a few years ago and fought with them to get more money, wasn't too hard in this instance but calling them a bunch helped.
They should cover all of the goodies you had on it but you'll probably need receipts for them. I'm assuming you have a local agent, try going through them and bring them the receipts.
Just be ready for a fight and be prepared to be aggravated each time you talk to someone.

Well, on a better note, I was contacted by Commerce today. They're giving me the full cost that I paid for the bike, plus sales tax, registration and title fees. And they got approval for the full cost of every aftermarket part I bought for it.
So, part 1 of 3 will be complete. They're going to send American Honda the payoff on the bike and me a check for the balance. (about $3K after the payoff)
Now for parts 2 and 3, which are the replacement gear and the medical expenses. Both of which are still ongoing. I emailed the gear receipts, along with the new helmet receipt to her insurance company. I don't expect to hear anything until sometime next week.
But things are looking up.

I hope you make out well with the gear. I heard from Commerce today and they covered my helmet but would not cover my pants. The pants were not that expensive and can be fixed up to be usable. Only the first layer of cloth was dammaged. But I am real glad that they paid the full price of the helmet. I already ordered a new one.
I am still waiting to see what they want to do about the bike. The first estimate missed half of the damage and they sent a check. They have been back and agree with the rest of the damage which more than doubled the repair costs. I want to go riding so I want it fixed or the money to replace it soon.
have you looked into how much it would cost to buy the bike back from the ins company?
