I don't have a criminal justice or law degree, so this is just speculation, but...

The culpability of mens rea may only hold to the point of him knowing he was intending to harm or maim, not intending to kill. In other words, he didn't "know" hitting the bike would kill the rider, only that it would hurt or scare him, which could have been the admitted intent...like if his statement to the officer on scene was "I was just trying to scare him." Thus the assault charges. It could also be due to the fact that it was between two vehicles, not a vehicle and a pedestrian. I'm curious on the specifics myself.

That being said, as a plaintiff I'd want to push for attempted vehicular manslaughter. Hope this punk gets his in the end.
